Reference is made to that
certain trust deed made by
KRISTA KAY SCOGGIN, as
Grantor, to TICOR TITLE, as
Trustee,* in favor of TRAN CO.,
a corporation, as Beneficiary,
dated March 16, 2009, record-
ed March 18, 2009, in the mort-
gage records of Polk County,
Oregon, as Instrument Num-
ber 2009-003001, covering the
following described real prop-
erty situated in said county
and state, to wit:
Lot 6, PONDEROSA RIDGE,
in the City of Dallas, Volume
13, Page 30, Polk County, Ore-
gon.
Said real property is com-
monly known as 539 Heath
Street NW, Dallas, Oregon.
*The successor Trustee is
Stephen L. Tabor, Attorney at
Law.
Both the Beneficiary and
the Trustee have elected to
sell the real property to satis-
fy the obligations secured by
the trust deed and a Notice of
Default has been recorded
pursuant to Oregon Revised
Statute 86.752. The default
for which foreclosure is
made is Grantor’s failure to
pay when due the monthly
payments in the sum of
$1,316.55 per month for the
months of February, 2015
through July, 2015.
By reason of the default,
the Beneficiary has declared
all sums owing on the obliga-
tion secured by the trust deed
immediately due and payable,
those sums being the follow-
ing, to-wit: $193,093.09 with in-
terest thereon at the rate of 6.9
percent per annum from Au-
gust 10, 2015, plus unpaid in-
terest in the sum of $7,448.75;
together with late fees, title ex-
penses, costs, Trustee’s fees
and attorneys fees incurred
herein by reason of said de-
fault; and any further sums ad-
vanced by the Beneficiary for
the protection of the above de-
scribed real property and its
interest therein.
WHEREFORE, notice here-
by is given that the under-
signed Trustee will on Decem-
ber 29, 2015, at the hour of
11:00 o’clock, A.M. in accord
with the standard of time es-
tablished by ORS 187.110, at
the following place: The front
steps of the Polk County
Courthouse, 850 Main Street,
in the City of Dallas, County
of Polk, State of Oregon, sell
at public auction to the high-
est bidder for cash the inter-
est in the described real prop-
erty which the Grantor had or
had power to convey at the
time of the execution by
Grantor of the trust deed, to-
gether with any interest which
the Grantor or Grantor’s suc-
cessors in interest acquired
after the execution of the
trust deed, to satisfy the fore-
going obligations thereby se-
cured and the costs and ex-
penses of sale, including a
reasonable charge by the
trustee. Notice is further
given that reinstatement or
payoff quotes requested pur-
suant to ORS 86.786 and
86.789 must be timely com-
municated in a written re-
quest that complies with the
statute addressed to the
Trustee either by personal de-
livery to the Trustee’s physi-
cal office set forth in this no-
tice, or by certified mail, re-
turn receipt requested, ad-
dressed to the Trustee’s post
office box address set forth in
this notice. Notice is further
given that any person named
in ORS 86.778 has the right
under ORS 86.778 to have the
proceeding dismissed and the
trust deed reinstated by pay-
ing the entire amount then
due (other than such portion
as would not then be due had
no default occurred), together
with costs, Trustee’s fees and
attorney fees not exceeding
the amounts provided by ORS
86.778, and by curing any
other default complained of in
the notice of default that is
capable of being cured, at any
time that is not later than five
days before the date last set
for the sale.

Interest Meeting
Monmouth, Oregon - The
U.S. Army Corps of Engineers
has scheduled a public work-
shop to present information
on the upcoming and ongoing
remedial investigation and
feasibility study at the former
Camp Adair, a Formerly Used
Defense Site located near Cor-
vallis, Oregon. The public
workshop will be on Wednes-

day, November 18 from 6:30 to
8:30 p.m. at Western Oregon
University, 345 Monmouth
Ave., Monmouth, OR, 97361.
The meeting will be held in
the Willamette Room, located
on the upper level of the
Werner University Center (lo-
cated on the corner of Mon-
mouth Ave. and Church St.).
Parking will be available in Lot
H. The public will be able to
view displays and exhibits re-
lated to the investigations on
the former Camp Adair. Corps
representatives will be on
hand to answer any ques-
tions.
Additionally, for community
members interested in partici-
pating in a Restoration Advi-
sory Board (RAB), information
about the formation of a RAB
will be available at the work-
shop. Those who would be in-
terested in participating in a
RAB concerning the former
Camp Adair are encouraged to
attend.

the Monmouth City Code Sec-
tion 17.15.170 requiring a one-
year warranty bond on all pub-
lic improvements and land-
scaping when installed in the
public right-of-way.
The Planning Commission
will make a recommendation
to the Monmouth City Council

amendments. The City Council
then makes the final decision.
A second public hearing will
be scheduled before the Mon-
mouth City Council to consid-
er this request. That public
hearing is scheduled for Tues-
day, January 5, 2016 at 7:00 PM

The public hearings will be
conducted in a manner, which

PURPOSE OF THE HEAR-
INGS: The Polk County Plan-
ning Commission will hold a
work session and a public
hearing on December 1, 2015
and a public hearing on De-
cember 15, 2015 to receive tes-
timony and consider text
amendments to the Polk Coun-
ty Zoning Ordinance (PCZO).
The proposed amendments im-
plement new State law, House
Bill 3400 (2015), and would es-
tablish local land use regula-
tions governing recreational
and medical marijuana.

ning Commission will receive
testimony and make a recom-
mendation to the Board of
Commissioners. The Board of
Commissioners will consider
the Planning Commission's
recommendation, receive tes-
timony, and make a final local
decision on this matter. Writ-
ten comments may be direct-

may be submitted prior to
each hearing at the Polk
County Planning Division.

written testimony may be ren-
dered at the public hearings.
Written comments received
by 5:00 PM on December 4,
2015 will be included in the
staff report to the Planning
Commission for the December
15, 2015 public hearing. Com-
ments received after that time,
but prior to the hearing, will be
provided to them at the hear-
ing.
Failure of an issue to be
raised in person or by letter, or
failure to provide sufficient
specificity to afford the deci-
sion maker an opportunity to
respond to the issue, pre-
cludes an appeal to the Land
Use Board of Appeals (LUBA)
based on that issue. A deci-
sion may be appealed to LUBA
within 21 days after the mail-
ing of the decision. Contact
LUBA or the Polk County Plan-
ning Division for LUBA appeal
procedures.
