supreme court has handed down an
important decision in the test case
brought at the last term of the court
as to the permanent increase of the
membership of the supreme court, and
as to whether there exists a vacancy in
the offices of governor and lieutenant
governor as a result of the death of
Governor Rogers. The opinion of the
court is unanimous that there is no
governor to be elected this fall, but
that McBride tills the vacancy to the
end of his term. The judges are di­
vided on the question of an increase
from five to seven in the membership
of the court.
