JUDGE GALLOWAY'S DECISION REVERSED On (he State University Ref erendum Petition MUST GO TO THE VOTERS Says the State Supreme Court Im provements at the University Will be Held Back as a Result. The Mate supreme court lunde 1 down decisions Tuesday on the ref erendum cases appealed from Judge (Jalloway's court. The cases were: Palmer & Walker, -appellant vs. Secretary of State Benson, a man damus suit to compel hint to ac cept and place on file the petitions for the relprndnm of the State University appropriation act, re jected on t! srouud of insufficient title. John 1'. Logan, respondent vs. the Secretary of State, appel lant, and Sheriff H. L. Stevens, of Multnomah, respondent vs. the Sec retary of State. These are suils to enjoiu the Secretary of State from filing the petitions of the referen dum ou the Freeman compulsory railroad pass bill, respectively, be cause of omissions of the voters' warning clause The suit involving the validity of th" State University appropriation act petition came up on mandamus proceedings Haiust Secretary of State Benson, instituted by Cyrus II. Walker and Eugene Palmer, of Linn county, an behalf of the grange, to compel him to accept and place the petitions on file not withstanding the opinion of Attorney-General Ci a wford holding them invalid on account of the insuffi ciency of the title of the act to be referred as stated in the petitions. Judge Galloway held in sub stance, that the referendum peti tions in the three cases wire insuf ficient and void upon several counts, but principally because of insufficiency of the title of the act to be referred in the case of the the State University appropriation bill and the omission of the warn ing clause from the compulsory railroad pass act and the Multno mah county sheriff's prisoners' act and likewise the University bill. President Campbell ot the Uci versity, in speaking ol the decision says: "Of course we are disappointed the Supreme Court has decided against us, but the only thing to do now is to make the best possible with what we have. The efficiency of the University need not bo seri ously affected this jear, for, while I cannot make prom:es for the facul ty, I believe they will prove as loy al as they did two years ago wheu the general appropriation bill, in cluding the money for the Univer sity, was held back. At that time, members of the liu ulty agreed to accept reductions in thei.- salaries, the deficiency lo be mule up if Hie. appropriation were rt leased, arid I believe the Incnlty is just as loynl now as it was then. l'rofes-ois stayed, not because they hud no where else to go, for many received flattering offers from other places, but because they believed in Ore gon and in the State University. "The University will get along very well, and if the faculty prove as loyal as before, the individual student need not feel the loss for this year. Of course we could ukc more equipment. We need $ro,ooo worth more of books for the library and more furniture for the new li brary building. Some new equip ment has been added the prist year in the engineering departments, so they are in fairly good t.hupe. "This withholding of the appro priation simply makes the Universi ty mark time instead of advancing as we would like.
