J. W. Cook at one time sole owner of the Musick mine, in Bohemia,
was hi town Monday, he has been looking over this section a little with
H. S. Reed who is interested in several good properties in Josephine
and Jackson counties (both placer and quartz.) Mr Cook is well pleased
with what he has seen in this section. He says the Musick niiue will
start up again this season. Journal.
BARRETT'S MINING LAW.
The bill passed by the recent legislature known as the Barrett law
is now in full force and effect and for the benefit of prospectors and
others it is published in full as follows:
Sectiofi i. Any person, a citizen of the United States, or one who
has declared his intention to become such, who discovers a vein or lode
of mineral bearing rock in place upon the unappropriated public domain
of the United States within this state, may locate a claim upon such vein
or lode discovered, by posting thereon a notice of such discovery and lo
cation, which said notice shall contain: First, the name of the lode or
claim; second, the name or names of the locator or locators; third, the
date of the location; fourth, the number of linear feet claimed along the
vein or lode each way from the poinl of discovery, with the width on
each side of the said lode or vein; fifth, the general course or strike of
the vein or lode as nearly as may be and by defining it from some promi
nent monument, mound or land mark, and by defining the boundaries
upon the surface of each claim so that the same may be readily traced.
Such boundaries shall be marked within thirty days after posting of
notice, by six substantial posts, projecting not less than three ieet above
tne sunace oi me ground, ana not less man lour incnes square or in
diameter, or by substantial mounds of stone, or earth and stone, at least
two feet in height, to wit: One such post or mound of rock at each
corner and at the center of such claims.
Sec. 2. Such locator shall, within 6o days from and after the post
ing of the location notice by him upon the lode or claim, file for record
with the recorder of conveyances, if there be one who shall be the cus
todian of mining records and miners' liens, otherwise with the clerk of
the county, wherein the claim is situated, a copy of the notice so posted
by him upon the lode or claim, having attached thereto an affidavit show
ing that the work required to be done by Section 3 of this act has been
I done and performed, and shall pay to the recorder or clerk a fee of 1
for such record thereof, which sum the recorder or clerk shall immedi
ately pay over to the treasurer of such county and shall take his receipt
therefor, as in the case of other county funds coming into possession of
such officer. Such recorder or clerk shall immediately record such loca
tion notice and affidavit aunqxed thereto. No location notice shall be
entitled to record or recorded until the work required by Seetion 3 of
this act has been done and the affidavit in proof thereof is attached to the

ing of the notice of discovery upon his claim as aforesaid, and before re-
) cording the notice of location, as required by Section 2 of this act, the
I locator must sink a shaft upon the claim located to a depth of at least 10
Ieet Irom the lowest part ot the rim ot such sliaft at the surface, or
deeper if necessary, to show by such work a lode or vein of mineral de
posits in place. A cut or crosscut or tunnel which cuts the lode at a
depth cf 10 feet or an open cut at least six feet deep, four feet wide and
10 feet in length, along the lode in any manner discovered, is equivalent
to such discovery shaft. Such work shall not be deemed a part of the
assessment work required by the Revised Statutes of the United States.
The locator or some one for him who did work upon and has knowledge
of the facts relating to the sinking of the discovery shaft, shall make and
attach lo the copy of the notice of location to be recorded an affidavit
showing the compliance by the locator with the provisions of this sec
tion, which affidavit" shall be recorded with such copy of the location
notice.
Sec. 4. Inasmuch as the .present law prescribed an unreasonably
short time for the marking of the boundaries of mining claims and im
poses hardships upon persons discovering mining claims, an exists and
this act shall take effect and be in force irom and after its approval by
the governor.
