PLANNING COMMISSION - CITY OF
DRAIN, OREGON
Notice is hereby given that the Drain
Planning Commission will hold a public
hearing on Monday, November 6, 2017,
at 7:00 p.m. in the Meeting Room, of the
Drain Civic Center, 205 West “A” Avenue,
Drain, Oregon. The purpose of the hearing
is to take public testimony, either written or
oral, on a request by Warren DeLaVergne
& Earnie Malchow for a variance to Section
9.610 Maximum Structure Height (3’ if less
than 20’ from the front property line, or less
than 10’ from street side property line of
a corner lot; 6’ elsewhere). The subject
property is located at 105 Second St., 115
Second St., 135 Second St., 237 W. B
Ave., 0 W. A Ave., zoned Commercial (C-
1) and is located at Township 22, Range
5, Section 17AB, Tax Lot 5300, 5300A1,
5500,5600,5700,5800 on the Douglas
County Assessor’s Map.
Criteria for Decision Making:
A variance in the requirements of the
Drain Development Code or Standards
Document may be granted if the following
criteria are met: (a) the property owner is
unable to enjoy the substantial property
rights enjoyed by other in the same
zoning classifi cation; (b) the application
of rules and regulations would cause an
undue or unnecessary practical diffi culty
or physical hardship, (c) the variance
will not be materially detrimental to the
purposes of this Code or property in the
same zone or vicinity in which the property
is located; (d) the variance is consistent
with and promotes the objectives of the
Comprehensive Plan; and (e) the variance
granted is the minimum variance that would
alleviate the hardship.
Submitting Testimony:
The applicant and other participants may
present evidence and rebut opposing
testimony at the hearing. Prior to the close
of the hearing, a participant may request
that the record be kept open so that more
evidence may be submitted. After the
record is closed, no further testimony may
be received. Failure of an issue to be
raised before the close of the fi nal hearing,
in person or by letter, or failure to provide
information that is suffi ciently specifi c to
afford the decision-maker an opportunity
to respond to the issue, precludes appeal
to the Land Use Board of Appeals (LUBA)
based on that issue.

All documents, evidence and applicable
criteria to be used by the City may be
inspected at City Hall. The staff report will
be available for inspection seven days prior
to the hearing. Copies of all documents
