The forty odd caadldates for, coun
ty offices in the various counties of
the state who violated the primary
law by falling to file their expense ac
counts within the legal time of tea
days after the election, and who were
actually nominated, need not fear that
the county auditors can keep their
names off the official ballot for the
general election.. This point was set
tled absolutely by the .state supreme
court In an. opinion rendered in the
ease, of Hiram O. Fuller, republican
candidate for treasurer in Lincoln
county, against Ira N. Corey, county
auditor.

Many people' in Oregon' own pro
perty in different parts of the state.
Nearly every property owner. In one
way and another, would be affected
If the county division scheme is not
voted down. One of the results or
the scheme would' be to increase the
people's taxes; in some cases, taxes
would be doubled.' But the people will
be guided "by sane judgment and will
vpte "No" to all these - measures
which,- declares the Eugene Register,
were foisted upon the public by pro
fessional politicians and ambitious
little towns. , That paper 'says editor
ially: J'Nlne county division Bchemes are
bidding for enactment under the In
itiative, in Imitation of Hood River
county's success two years ago, and
the end is not yet. Here is direct
legislation gone to seed and dissemin
ating trouble through the fair expanse
Of Oregon, says the Oregontan. .
"The latest Is Deschutes county.
presenting a petition to the secretary
of state and aBklng to be carved out
of the northwest part of Crook coun
ty, Umpqua, Williams and Nesmith,
with overlapping boundaries, seek in
dependence from Lane and Douglas
counties. Umatilla county is wrestling
with the ambitious schemes of Orch
ard and Hudson. Clark desires sepa
ration from Grant, Otis from Malheur
and Harney. A strip of Clackamas
seeks annextion to Multnomah.'
Politicians, office seekers and am
bitious little towns are - putting up
the'se county partition schemes. More
counties will provide additional of
ficial places and other patronage.
They will also make higher taxes and
more trouble for property owners.
It Is reaching a point in Oregon
where the electorate will feel obliged
to vote uniformly against all these
new counties. The voters cannot in
form themselves on the many local
details Involved, in order to legislate,
therefore they are likely to take the
view that their safest action wllj be
that of voting "No" on the "whole
bunch." ,
"The Oregonlan's position on this
matter Is correct It should add, how
ever, that it is important for those
who oppose this wholesale formation
of new counties to be sure and vote
as they feel about It, and put a "No"
In front of each ono- or every pro
posed new county will carry. The peo
ple can put it up to the legislature to
frame a fair and just division law
that will leave formation of new coun
ties to the territory thus affected and
relieve the whole state of responslbil.

ABUSE OF THE INITIATIVE.
It Is a gross abuse of the rights
guaranteed by the Initiative and Ref
erendum Amendment to the Oregon
Constitution to bring up woman suf
frage at every general election. This
measure was submitted' lu 1900 and
beaten, by a plurality of 21?7. In 1906
It was again proposed and was beat
en by a majority of 10173. In 1908
It was again oi the ballot and it was
beaten by a ma'o:lty of 2W49. NoU
withstanding the repeated defeats
more decisive at each election, the
same measure' la again on the bal
lot this year. The ballot title 1st mis
leading and Indicates a proposal to
give votes to taxpaytag women only,
but the measure to be voted on is
the same proposition which the peo
ple have so often and so -recently
condemned: It should be voted down
this year by an Increased majority.

"There are no less than e!ght appli
cations for the creation of new coun
ties to be voted upon by the people of
Oregon at 'this fall's election. Though
there may be one or more of these
new county schemes possessing some
degree of nferit and are prompted by
good faith. It would appear that In
the main Uey are not entitled to the
favorable consideration of, the people
at large, and as a matter of expedi
tion and good public policy all of
them should be defeated.
"In the first place the Herald be
lieves that the creation of a new
county is a matter devolving upon the
legislature and should not be submit
ted to a vote of the people at large.
who cannot possibly have any intelli
gent Idea of the demand for 'such pro
posed new counties and are, therefore,
In no sense competent to vote upon
the measures. What does the average
voter of the northeastern part of the
state know about the practicability or
wisdom of the clamor of the south
western portion of the state for the
creation of a new county? Certainly,
in the majority of cases, he would not
be able to cast an intelligent vote on
the proposition.
The submission to a vote of the
people of the whole state of these var
ious county division schemes, there
fore, would seem highly Impracticable,
if not unwise. Moreover, the success
of these various division schemes
would establish a bad precedent,
which might tend to retard the healthy
growth and ' reasonable prosperity of
many counties of the state.
There are doubtless counties In
Oregon which should be divided into
two separate county divisions, but
these. the Herald believes, should be
taken care of by the legislature and
not voted upon by. the people of the
state at .large, who cannot possibly.
Judge of the merits or" wisdom of the
proposed division of a remote section
of the state, and in which the voters
at large can have no reasonable Inter
est. Many of the county schemes up for
consideration this fall are without
question Ill-advised and prompted by
impure motives, and the Herald sug
gests a negative vote on all county
measures as the most practical rem
edy for the present county division ep
idemic. COUNTY DIVISION
Under the present laws In the opin
ion of eminent lawyers, counties can
only be divided or boundaries changed
by the vote of the people.
All laws snould be obeyed. Some
laws should be appealed or amended.
The law creating new counties is un
fair as voters are asked to create new
counties where . they cannot ' know
the local conditions and might form a
new county where four-fifths of the
residents of the old county are op
posed to it. .
What do the. voters of Clasop know
of ' the needs of Grant, Malheur,
Crook, Umatilla, Douglas, Lane, Wash
ington, Clackamas and Multnomah
They could vote Just as intelligently
for' the county officers In these coun
ties 'as for their division or the chang
ing of the boundaries.
There is strong opposition to di
vision in all the counties mentioned
and it would seem to be but justice
that these localities should settle their
own local differences.
You will have the privilege of vot
ing tor a bill to leave the function of
new counties and municipalities to the
districts Interestd. As between man
and man, would not this plan be the
more equitable? -
The average . voter will certainly
take this view of it. In all fairness
now, will not your conscience and
sense of right tell you to vote against
all division and vote "Yes X 3S2,'
which will relieve you of the task of
voting for measures with which you
can not be familiar. . ,

Would Change State Map
Beyond Recognition.
"Business men of Oregon will do
well to take note of the Innumerable
county division bills for the considera
tion of the people next fall. Already
so many division measures have been
filed with tlie secretary of 'state that
It half of them are adopted the map
of Oregon will be so changed that it
will not be recognized even by a na
tive son," declares .the Pendleton Eas
Oregonian in its Issue of July, 25.
Furthermore the indiscriminate
creation of new counties' cannot fall
to Increase taxation. This state can
not create ten new counties and pro
vide for ten additonal sets of county
officers and hope to get along with
present levies. The.dlvislonists make
assertions to the contrary.; But that
campaign' talk. That same argu
ment was advanced In favor of the
creation of Hood River county. Yet
A. Echlffler, a Pendleton tailor who
owns property in Hood River, found
bis taxes Increased 61.4 per cent the
first year of the new county's exist
ence. It is the history of every new
county that division brings on increas
ed taxation. This is only natural.
Another feature ot these division
rights'is the fact that division meas
ures are sprung when the people re-
lding in the proposed new counties
do not want division at all. Take for
Instance the Orchard county scheme.
Manifestly the people residing In the
greater portion of that proposed coun
ty do not want division. Two of the
four towns included in Orchard coun
ty are hotly opposed to the division.
They are Weston and Athena. They
have good reason for being opposed.
Division will mean increased taxation
and that business now held by Athena
and Weston' will be diverted to Walla
Walla. Milton people Imagine they
will get that . business. But thev
won't. Milton Is practically a suburb
of Walla Walla and such it will al
ways remain. If Orchard county car
ries, that business wi'l be lost to this
state.
"The Orchard county measure was
drafted in secret by a little clique qf
Milton business men. It Is purely a
selfish measure. Representative men
living right in Milton and in Free-
water are opposed to the proposition
In communications to this paper they
have so declared tnemselves. Even
the newspapers of Milton and Free wa
ter have failed to take up with the
proposition. Neither the Freewater
Times or the Milton Eagle advocates
the division measure editorially and
this fact has caused much comment.
The Weston Leader and the Athena
Press have declared themselves as
utterly opposed to division. '
LET POPULATION INCREASE.

The Prinevllle Review sizes up the
situation wisely when It says that the
population In most of the counties
where county division Is being agi
tated is too small and , scattering.
Many of the districts are too sparsely
settled to permit the scheme. Resi
dents and property owners would be
taxed so blgh that it would mean ruin
to a large number. Walt until the
counties have more people and the list
of taxables warrant county division,
advises the Review as follows: 1 '
"It would be unwise to make any
sort, of division of Crook County Just
now. It Is too thinly settled yet. In
due course of time, when the parent
county shall have- attained 25,000 or
30,000 and the list of taxables war
rants It, division will be sure to come;
It is Inevitable. But It is not business
sanity to divide a county of less than
10,000 sodls, and a moment of : sober
reflection should 'convince any pne of
this. . When the proper time jrrves
and a Just county division lawj is en
acted, the three cities most concern
ed, Madras, Redmond and Bend, all
of which ' have' division schemes in
mind,' can settle the matter between
themselves. But so long as the whole
state is required to vote upon a mat
ter with which only a small part Is
even remote y concerned,, we would
advise electors to vote an emphatic
NO, not only on the. Deschutes' propo
sition, but every other county bill."
NESMITH ' COUNTY.
'The idea of creating Nesmith coun-
ty Is commendable, but Is the manner
of creating it 'commendable. It'll
hoped that In time a Nesmith county
wl l be formed, but It sbould be done
In a way that would be approved by
