SALEM. June 8. Abundant lustifi-
cation for the strictness required by
courts in respect to . tax sales is
pointed out by Justice McBride of the
supreme court, In an opinion given
this morning in which the decree of
Judge Knowles, 0f the circuit court
from Union county, i3 affirmed and
an unfortunate woman, who has been
an Inmate in the Insane asylum since
April, 1896, is restored to her prop
erty rights of which she was depriv
ed by means of a defective sale for
delinquent taxjs, The opinion was
given in the case of Rachel J. Raf
ferty, an insane person by A. D. Buz
zard, her guardian, respondent vs.
A. B. pavs, appellant, "
When A. D, Buzzard was appointed
guardian of Mrs. Raffertv'H stati.
in September, 1907, he immediately
uosan proceedings for the annull.
ment of the tax aal tha nrnnarfv
having been bid in by Davis for
$13.70, and the county court having
delivered over to Davis a certificate
of sale to the land, and to recover
six years rental for the property from
Davis at $150 Der year or QftO An
examination of the evidence and rec
ords discloses that the wholo nrn
ceedings from the assessment to the
final sale are more or less defective
and irregular nnd simply amount to
tailing of the property away from
one person and giving it to another.
Justice McBride says these proceed
ings are the more deplorable when
an insane and defenseless woman Js
made the victim of the transaction.

Firtt Conviction In County Under
New Law License For
Everybody.-
The above case Is of general In
terest to the people of this county
as another Illustration of the usual
defectiveness of tax titles nH at
special interest because the parties
to the suit are known to many res!
dents here. D. W. Sheahan of Enter
Prise won the case for the guardian,
and ex-Clrcult Judge T. H Crawford
of La Grande and L. J. Davis of

The first conviction under the new
fishing law was secured by Deputy
district Attorney Dill atJo3eph, Tues
day, when J. T. Sutton was fined $23
and costs for catching a trout with a
graD nook. The new law absolutely
forbids the catching of trout with
any thing except hook and line,
Sutton was found at th lakn bv
Mp. Dill and Deputy Game Wardan
jClemons in po3seision of a trout that
nad been caught with a hook at the
end of a po!e. Sutton claimed the
fish had not been caught in the lake
or within 300 feet of the lake, and
Uie Rusk law was not therefore vio
lated. This was true but the Eeneral
law was, as such fishing is prohibited
in any stream.
The trial was by jury before
Justice Sheets at Joseph aud result
ed in a verdict of guilty.
Clerk Boatman and Deputy Bilyeu
are having their troubles these days.
i The attorney general has interpreted
(the new fishing law as requiring
everybody, old and young, to take out;
an anglers license. The only differ
ence Is that boys under 15 don't have j
to pay for theirs, and Boatman and
jBIlyeu are kept busy filling out'
blanks for the lads.
County Surveyor II. E. Merryman
Is working on the papers for three
changes on the Ant Flat road, that
will In the aggie .rate rerhiCB thP Us.
tance between Enterprise and Sled
Springs and the entire North Coun
try over oneha'f mile, and very
materially better the road by elimi
nating the worst Willi and making
other grades les-i.
The first change Is at the north
end of Ant flat where a straight
route onnoith over the Flathers Bros,
land will be followed, instead of the
quarter mile jog to the east. This
mange shortens the road one-half
mile and betters the grade.
At the L. P. Wright place, nine
miles north of town, a change will bi
made to avoid a steep hill, leaving
the road on a water grade. Thu
change will also shorten t.h mmi
from 12 to 18 rods.
The third change Is on the W. F.
Rankin place, and is beine Dialled
so that the county can acquire the
land on which the new route is
already graded.
If in addition to those changes, sev
eral sharp pitches would be done

CHURCH NOTES.
The District Ep worth League con

here June 24-27. has been called off
by the district executive committee.
The district president of the Enworth
i'League, Mrs. Cates, of Baker City, has
been 111 and was unable to arrange
the DrOKram. In addition tn this the
fact that two other Methodist events.
occur soon, the Sunday school con

International Epworth League con
vention at Seattle July 7-12, renders
it Impracticable to get the speakers
or the delegates at the desired time.
For these reasons the executive com
