To construct, enuip, own and op
erate an electric railroad from Troy
to where the south line of town
bIiId 3 south, ranee 44. crosses Hur
ricane creek (12 miles south and
two we3t of Enterprise) Is one of
the 14 objects set forth in the ar
ticles of Incorporation of The Troy
Mercantile, Milling and Power com
pany, filed Thursday In the county
clerk's office. The capitalization
is $20,000 and the incorporators are
R. W. Barkham, H. E. Merryman
and Mary P. Merrymau, with the
principal office in Enterprise.
Among the other objects of the
company are stated to be the buy
ing and selling of merchandise, pro
duce, . grain, the construction' and
operation of flouring, saw and plan
ing mills, dealing In livestock, build
ing fljme3. ditches, dams, tunnels,
bridges and reservoirs, selling or
lea -Ing water and water rights, pro
ducing and selling electric light,
power, and heat, acquiring riparian
rights, buy and acquire land for
rights of way. plants, town sites,
etc., and borrow money on bonds.

In Favor of Homesteader.
The suit of the government against
tho homestead entry of Frank Cum
mings, over on Snake river, has been
decided by the La Grande office in
favor of Mr. Cummlngs, who was
represented by Attorney D. W. Shea-han.
J. W. Childers returned from La
Grande, Wednesday, nearly recovered
from a successful operation he under
went in a hospital several weeks ago.

Secretary Ballinger Includes Ovf
Seven Million Acres Of Oregon
Land.
Washington', April 28 Secretary
Ballinger today designated 157,176,
800 acres of land In the United States
to which the 320 acre homestead law
applies as coming . within provision
of the law. The states affected are:
Oregon, Washington, Utah, Wyoming,
New Mexico, Nevada, Arizona, Colo
rado, Montana.
Included In the land designated
are 7,000,160 In Oregon and 3,576,
960 in Washington. Diagrams showing
the lands subject to entry are being
sent to local land offices, it is be
lieved that ,40 per cent of the area
designated, except in Nevada, Is. held
by individuals through ' some color
of title." If all the land were suit
able It would make 492,000 home
steads. The lands are not suscept
ible to Irrigation from any known
source of water supply.

Salem, April 28. Formal complaint
has been filed with the railroad coin
mission by the Enterprise Commer
cial club, charging unjust discrimi
nation against Enterprise and Joseph
on the part of the O. R. and N. The
complaint alleges that the railroad
favors Elgin and the other towns
nearer the mail line, and that con
tinuous distance tariffs are applied
to all towns on main or branch lines
except those on the Wallowa exten
sion, and that the branch rate there
Is proportional to mileage added to
continuous tariff on all . business
originating or destined to the towns
beyond Elgin. Wool Is the principal
commodity shipped in sacks and
bales from these towns.
The railroad commission has noti
fied the Oregon Railway & Navi
gation company and It will be asked
to Bhow the alleged discrimination
does not exist and why the condi
tions complained of are maintained.
The foregoing dispatch Is In the
main correct. The complaint If suc
cessful will do away with the double
local rates betwean Wallowa valley
points and La Grande on both Incom
ing and outgoing freight, and bone
fit every consumer and producer In
the county. The reductions In
freight would amount to thousands of
dollars annually.

A. C. Miller endeavored to securo
a game for the local team at La
Grande but Manager Lincoln stated
an arrangement had been entered in
to with the amateur league, composed
of towns in Uni-m and Uaker coun
ties, by which all Saturday and Suiir
day dates were taken until July 1.
The Wallowa team has raised I'JOO
with which to buy grounds, the only
thing that wai lacking for Wallowa

Practically the entire 1009 crop of
Wallowa county wool has been con
tracted during the last few days, at
prices ranging f.om 18 to 20 cents;

The bids for the new Methodist
Uiurch at Joseph were opened Wed
nesday but the contract was not lot,
the bids being returned as all were
too high.
S. R. llaworlh has gone to Port
Orford, Curry county, In the extreme
southwestern corner of the statu, l
look after , "sand,'' and was accom
panied by those noted sand experts,
A. M. Wagner and Jacob Iluuer. All
three are interested in the company
that proposes to develop a fresh
water harbor there by a canal con
necting alul:e with the ocean, and lha
consequent building of a city around
