ness by use of the statement, “It

Parker, the “John Doe” wit­
ness of the state whose sensation­
al testimony climaxed the trial,
was then called.
He was very
deaf.
Parker, an Englishman, said he
lived on Elliott Creek, a tributary
to tbs Applegate river, that ha
was a miner for nearly 55 years.
His testimony was evidently need
by the state to show the way th e
boy left the country after the
crime..
He said he lived along, and
that on October 12, 1922 he was
visited by a young man carrying
a gun who asked the trail leading
to the Bine ledge summit. “I
wasn't vary willing to tell him so
he pointed the gun at me and
said, 'Move, «move” the old man
said. “He said Jie was from Dona-

His positive identification of th e

his testimony told of Hugh’s
travels following the crime as he
said Hugh* related them to him.
He said Hugh told him he went
to San Francisco, then to Los
Angeles, where he worked with a
contractor near Long Beach, then
to Yuma, ElPaso, Tacos,
Fort
Worth, Dallr.s, guttle nock and
Emmett Arkansas, where he met
Bill Adams, doubling back to Mis­
souri, St. Louis and Chicago, then,
joined.the army in California and
went to the Islands.
McKenna
said Hugh told him that several
times h i was kicked off trains,
but by talking fast and appearing
neat aud telling them he was on
ids way to see a sick relative,
they let him go.
McKenna said Hugh refused to
talk about crime contending that
it was au unfair question.
Under cross examination Mo-
Kenna admitted that IJe qutszed
the defendant for two hours, after
which Hugh was taken to his cell
very ill and had to have a doctor.
He also admitted that Hugh said
he would not plead guilty to a
crime which he did not commit.
McKenna said that officers
would quip him every day he was
in the Alcatres prison.

ment he received at thé prison.

ferson admitted that everything
