The defense raised a storm of
objections to the application bas­
ing their stand on the fact that
other names were on the blank.
This Was overruled.
Other witnesses called during
the afternoon by the state were
Raules Moore, Medford attorney
for fourteen years, and states
attorney at the time the crime
was comiqUted.
He identified
many of the articles being used
as evidence. Following him, Fred
M. Stratton of Weed and special
officer for the railroad company,
told of «earching the mountain­
ous country surrounding the tun­
nel, and the discovery of a cap,
about one mile from the tunnel
and fifty feet from the railroad
track. A cap was then produced
which had figured earlier in the
case and the witness thought-it
was the same one. This cap was
positively Identified by J. C.
Beagle a* being the same that
was handed to him in the tem­
porary sheriffs office at Ash­
land shortly after the day of th«
holdup, and declared further
that he had seen the cap at the
Siskiyou station prior to his visit
to the sheriffs office.
