This surely ought to l»e sufficient, on this point. The Volstead act now, if it is to be attacked at all, should lie an issue in Congress, not in the courts. The Volstead act iR a measure for carrying out prac­ tically the principle of the eighteenth amendment. It can honestly lx? amended only in the light of expressing the purpose of the eighteenth amendment The eighteenth amendment puts a ban on the bever­ age use of liquors that “ intoxicate.” Any pnr|X)se to change the terms of the Volstead act, must be consistent on that one point.
