Terrill, Sheriff of Jackson County, Oregon, told me he had hired to catch the “bootleggers,’’ and that he, C. E. Terrill, was going to give Wiltse some of the confiscated whiskey, out of the Jackson County jail strong room, in order that Wiltse could have something to work with, and that he, C. E. Terrill, did give Wiltse a deputy’s star and took him over to the county jail at Jacksonville, Oregon, and got about three pints of whiskey for him; that J. J. McMahon, formerly deputy sheriff of Jackson I County, and Chas. Adams, Medford city policeman, hot It know of this oceurience, and can testify to the same; that I believe this happened to the best of my knowledge and belief, on a Saturday night, during the latter part of January, 1921, and that said Wiltse, after he had been turned loose to catch bootleggers with the whiskey bait, proceeded to drink the liquor entrusted to him, getting intoxicated, and while in an intoxicated condition, Wiltse told those with whom he came in contact with, liis business in Medford, and displayed bis tmdge; that J. J. McMahon phoned to me at Ashland, Oregon, about midnight from Medford, and told me of Wiltse’s actions, and that he, J. J. McMahon, had taken his star away from him, and started Wiltse out of town, telling him to get out and stay out, and that YVilLse was headed towards Ashland and for me to keep an eye on him, and see that he did not pull off anything again, which I did, for the balance of Saturday night and Sunday; tliat at the time I w’as carrying a special deputy sheriff’s star given me by C.
