CALKINS MMMlffWIflllll I 1 HIM ' !! WHO SAID PRICES HAD NOT !! All Boardman district will be in terested to know that the John Day project is showing signs of life. At 'east Judge Phelps has prolonged agony, for we will have to watch fully wait until his opinion is up held or turned down by the supreme court. Engineer Lewis and the new directors have gained a good lead, however, and hope will again spring forth for the ultimate realization of the project. Demurrer by officials of the John Day Irrigation District association and former state engineer John I. Lewis, to the setting aside of a con tract for $r0,000 between them for surveys and a report to be furnish ed by Lewis has b.een sustained by Circuit Judge Gilbert VV. Phelps, who has had the matter under advisement 1 during the past two months. In his opinion Judge Phelps held that the contract should not be set ! aside because the citation of ultra virus and quasi-fraudulent means was not sufficient to establish reason able doubt. Suit to set aside the con tract was brought by the Northern Pacific railroad, Smythe Bros., and other hold.ers of land within the gi gantic John Day Irrigation iroject. These parties hold, among Other things, that the directors of the as sociation had not authority to enter such a contract with Lewis because of the unconstitutionality of the law creating the district Judge Phelps decided, however, that since the supreme court of Oregon has virtually passed upon its constitulionallty several times since the origimial irrigation law was pass ed, his hands are tied and until such time as the supreme court, shall change, he is powerless to hear the question at issue. The Immediate cause for complaint by the Northern Pacific and Smythe Bros., was the provision which says: "All Irrlglble land shall be taxed the same". These parties contend that this vio lates the fourteenth amendment to the constitution in that it is unjust taxation and takes property without due process of law. The case will undoubtedly go to the supreme court. In his opinion Judge Phelps deal ly states, however, that the Northern Pacific and Smythe Bros., havi- ;i right to litigation on the legality of the contract entered into between Lewis and the directors. This con tract has been the subject for con siderable comment in (he papers of the state, inasmuch as the complain-! ing parties assert that United States engineers have already thoroughly Investigated the project. The case has another angle, too. At the last election- of directors, members of the district wrote in the names of two new directors and by concerted action defeated the two old directors who were up for re election by a ten to one vote. This action was taken because of lack of Confidence in the old board. The old board met and refused to seat the two newly elected directors because they had not been nominated and this case also came before Judge Phelps, who decided that the new directors were regularly elected and should be seated.
