A3T'rtI.. June i. JhSJ.-To the Hon
Astoria Water Commission Gentlemen!
In answer to your Inquiry as to the
pow'-r of the city of Astoria to construct
or extend water works beyond the c.ty
limits, I am taking Into consideration
th.. branch of the matter which a:pll-s to
the de-.ne of the government to obtain
water from the city, the furnishing of
which would necessitate) th'i extension of
a supply main outside of the llmtis of
the city of Astoria, to carry water to a
consumer. I 'have carefully examined
the chart 1 r provlslonH applicable to the
qi'sti.n and also the c In point
and I find that the law makes a distinc
tion between the two kinds of cai!"S, to
wit: Those In which It Is necessary to
construct works and lay pipes out aide th
limits of the Incorporation fir the pur'
P'rn of bringing water to oinsum'-ra and
to the reservoir Inside of the limits, and
those in which It Is desired as It 1 In
the case under consideration, to extend
mains to consumers outside the limits.
Our charter expressly provides that 'he
rommlswJon may acquire realty, conetrncf
ny and all necessary works In or out
tjt the city for the purpose of acquiring
a supply of water for the Inhabl bantu of
the dty, hut does not directly authorize
the construction or maintenance of mains
outside the city for the purposes of sap
plying water to consumers, non-reslI'mts
of the dty.
The charter does not prohibit the com.
mission from supplying water to a non-
resident of the city, who nviy tak liU
supply Inside the limits, It making n
difference what hi may do with the
water after he receives It. I ibut respect.
nKe authority hold to the same doctrine,
It la therefore my opinion that tlvcom.

I am of the opinion tluit the h'vo ar
