The case of tho sealing schooner Louis Olsen, seized In, Bchring . sea several months since by the revenue cutter Rush, on a charge of killing -seals within the prohibited, zone-ox, w tunes arounu uio Prybllov Islands, was tried in the United States district court yesterday, before Judge Bellinger. The defense set up that the schooner was outside the prohibited cone, and that she was not engaged in killing seals when captured. The only witness for the government was Lieuten ant Dunwoody. of the Rush, who brought the seized schooner to Astoria. The log books of the Rush and Olsen were also Introduced In evidence. According to the astronomical calculations of Lieutenant Dunwoody, the Olsen was, when seized, seven miles inside tho prohibited zone, and by dead recokonlng she was ten miles within. According to the reckoning oi the master of the Olsen, she was about seven miles outside of the zone when cap. tured. It was admitted that the crew were sealing on September 2, and killed 28 seals. There were irreconcilable dif ferences between the logs of the Olsen and the Rush, and United States Attor ney Murphy claimed that the probabilities were that the Olsen's log had been falsi fied, while Lieutenant Dunwoody could have no object in making Incorrect calcu lations or entries. Judge Bellinger was Inclined to take this view of the case, and to believe that the schooner .was within the prohibited zone and had been sealing there. He said the officers might not have known that they were, but that did not excuse them. When they approached the prohibited zone, they did so at their peril. He must conclude that the schooner was within the zone and the decision would be In acordance, This means that the Olsen and her cargo of 651 sealskins, in all worth some (10,000, are forfeited to the government, and that the defendants, Cole, Gullliams and Tho- nle. are liable to a fine of ?200 each.
