This is J10 lower than last year. , . .. In the admiralty court at Llverpod on May 22d, Justice Bruce delivered Judg ment in the action and counter-claim brough by Girvln, Baldwin & Eyre against the owners of the British ship Netherby in respect of a short delivery of a cargo of wheat carried by the ship from San Francisco. Particulars of this claim were given in the Astorian of last Tuesday. The Judge said: "The plain tiffs shipped on board the defendants' ship Netherby at San Francisco, 34,748 sacks of wheat. The ship delivered at Galway 34,116 socks, being less by 630 sacks than the bill of lading quantity. Not only was there a discrepancy In the number of sacks, but the weight of wheat delivered was less by about 23 tons than the quantity of Wheat said to have been put aboard at San Francisco. The evidence shows that the bags were weighed at San Francisco, and the dif ference in the weight taken at 6an Fran Cisco and the weight taken at Galway corresponds very nearly to the weight of 630 sacks of wheat. Again, there Is some evidence of the draft of the ship, from which It can be Inferred that she had on board about thirty-eight tons of cargo more than the wheat accounted for at Gaiiway. I cannot help coming to ths conclusion that theee 630 sacks were part of the cargo put on board at San Fran cisco. According to the evidence all the bags of wheat plaintiffs received were. after being emptied, carefully counted and weighed, and everyone concerned In the delivery of the cargo speaks as to ths quantity delivered being 630 bags. No one connected with the delivery sug gested that the plaintiffs got more cargo Shan there were bags, and it Is indeed be yond question that 630 sacks were un counted. If the contents of the missing 630 sacks were delivered to the Dlnln- ti'ff9, what would become of the empties? The fact that these eacks cannot be found anywhere shows, I think, beyond doubt that there was some grofS Irregu larity in the delivery at Galway. I thlnR the whole of the cargo shipped was not delivered to the plaintiff, and the de fendant neglected to deliver 630 sacks. Judgment will therefore be for the plailntlp for $1,000, and likewise for the plaintiff on the counter claim."
