TUB DAITA ASTORLVX, ASTORIA, SIWDAY MORXrXO, FEBRUARY 2u, 1893. ORDINANCE NO . NOTICE Cases Heard and Set for Trial Report of the Grand Jury. The circuit court met yesterday morn ing at 9:30, the case of the State of Ore gon vb. May Boss being called. Defend ant pleaded not guilty, and the case was set for trial on Tuesday,- the 27th. Charles Lawrence pleaded guilty to larceny and was sentenced to a term of one year in the penitentiary, and order ed to pay the costs of the action. In the case of the State of Oregon vs, Charles Henry, charged with assault with a dangerous weapon, defendant was given until tomorrow to plead. William Thomas, indicted for larceny, pleaded not guilty, and the case was set for trial. At this point in the proceedings the jurors not in the Olsen case were ex cused until tomorrow morning. Decree for plaintiff was granted and an order dismissing as to the Astoria Iron Works in the case of the Astoria Savings Bank vs. Eliza J. Hustler et al. The case of Charles Olsen vs. M. M Walker was next called and the follow Ing Jury sworn: E. P. Noonan, C. Brad; bury, W. J. Loomls, W. J. Denver, Oul Holmes, C. E. Anderson, August Juhrs, A. 3. Hill, E. B. Stoner, R. W. Warn staff, . John Beneke. The wltneses sworn were the plaintiff, J. L. Carlson jvuwnru nnuucit biiu XI. CiKHirom, in facts in the case are familiar to al readers of The Astorian, having been before the public at intervals durinr several months, and having occupied a prominent part In the proceedings oi the city council. Plaintiff was repre sented by George Noland, and Dr Walker by J. H. Smith, C. J.' Curtis anc" F. M. Hughes. The case was dismissed as to the city, the court holding thai the responslb'lity . for the burning o Olsen's trunk and effects at the time of the smallpox scare rested elsewhere Much of the afternoon was occupied by the argument of counsel. The grand Jury then came Into cour and returned a true bill against Andrcv Eskola, charging him with the crime o' assault. The report of the Jury was a follows: . "In the circuit court of the State of Oregon, for Clatsop county: I'Va Tr.. mi. . . . . . of the above-named court: r '.'We, your undersigned grand Jury fo the February, 1894, term of said court having now finished our Investigation make this our final report and respect fully represent: "That we have carefully investigated all charges of crime that have beer presented to uh, and have disposed of the same In such manner os we deemoO warranted by the evidence. "We visited and Inspected the count Jail, and found It clean and well kept r and the prisoners therein well treatef and kindly cared for. "Statements having Wen made In f local press that May Ross, who Ih now confined in the county Jail, has not beet properly cared for by the sheriff and hi deputies, we carefully investigated th' matter, and found that during the time May Ross has been confined in the coup ty Jail she has been properly cared for and that all statements to the con t ran are without foundation. "We found that the partition wall Ir the county Jail has settled so that the lloor has to bo cut away in order t open the door, and that the roof leaks We recommend that the county com have these necessary repairs mado Hoon as possible. "We visited the city Jail and found V in good condition. "We visited SU Mary's hospital which by contract is the county hoe pJtal, and Jtln with other grand Jurle In commending its excellent manage ment and the care and attention be stowed upon the unfortunate Inmates. "We visited the various county olllee and found the records and books neatb kept, and each of the county officer efficiently performing the duties of hi j office. The books of the clerk, sherl and treasurer having been experted b the lusb grand Jury, and it not belnr necessary for us to remain in sesslor over five days to attend to all the crlm inai business which came before us, w aid not deem it necessary for us to hav the books experted at this time, an' thereby prolong our session, but. loft th matter of exporting the books to tlu next grand Jury. The Jury were then ordered dlm-harced. In the case of Eva Wallnwn vs. Theo doro Bracker, a motion to amend com plaint was anrucd and allowed. Andrew Eskola was arraigned, and h" his attorneys, Kulton Bros., asked tha he te given until Monday morning tc nWd. An order was made to that ef .' THE RAILROAD SITUATION. Some of the members of the subsidy committee who went. to Portland to in terview Messrs. Baxter, DlcKinson et al., returned yesterday morning, and report that the prospects are favr.-able for the beginning of work at an early date. Mr. Baxter .is understood to be willing to sign the contract at once, if the Astoria people will guarantee the right of way to Goble. No time will be lost In wait ing upon the 'various owners of lund along' the river, and "dirt may be hy ing"- before the first of April. The Flavel syndicate will subscribe to the subsidy on terms acceptable to Mr. Bax ter and his associates, and to all ap pearance there is nothing that can now prevent the building of the road.
