' Action 1. That no person or persona ijh&li; In the City of Astoria, Clatsop Copnty, Oregon, cither directly or indi rectly, in person or by another, sell, barter or deliver, or knowingly permit tq b sold by another, or for or on his account, or otherwise, any wine, mali or spirituous liquors in less quantities tiHn one gallon, without first obtaining & license so to do from the City of As toria, in the manner In thlB ordinance hereinafter provided. Provided, thai nothing in this ordinance shall be con strued to apply to the sale of liquors fot medicinal purposes, made by a regulai licensed pharmacist upon a prescrlptloi. therefor made by a. regular licensed physician or surgeon, in the regulai course of such physician's or surgeon't practice to a patient, and for medicinal purposes only. " Any person violating any of the pro visions of this section shall be deemec guilty of a misdemeanor, and upon con viction thereof before the. police judge, shall be fined not less than Twenty-tivt LMlars,. nor more than Two Hundred Dollars,, or by Imprisonment in the citj jull until-such fine be paid, not to ex ceed One Hundred days. And it is here by made the duty of the Chief of Pollct and each police ollieer of the city tc make complaint to the City Attorney 01 each and every violation of the provi sions of this ordinance, and such viola tion must be prosecuted by such at torney. Kvery person applying foi a license to soil wine, 'malt or splrltuout liquors, in less quantities than one gal lon, under the provisions of this ordin ance, shall pay into the city treasur) the sum of Four Hundred Dollars pei annum, and In no case shall any Ucenm pa Issued for a less period than one year, and no license shall be in an) manner transferable. Provided, fur ther, that the Common Council shall re serve and have the right to revoke i license at any time. ' Section 3.
