The circuit court convened yesterday morning with Judge McBrlde on the bench, and W. H. Barrett prosecuting attorney. John McCormack and C. 13, Harraden were sworn In as bailiffs for the term. For various reasons O. F. Morton, A. E. Turley, P. H. Bagley, O. J. Peterson, C. E. Bain, and P. Wan Strom were excused from Jury service for the term. The following cases were continued for the term: James W. Welch vs. O. R. & N. Co.; J. M. Robb vs. J. W. Hume; Wyatt & Thompson vs. Anderson and Mary Olsen; Clatsop Mill Co. vs. Gray's River Logging Co Clatsop Mill Co. vs. Etnay Warnstaff; W. W. Wherry & Co. vs. Simon An tilla and wife; P. N. Kearney vs. H. D. Newberry. The- following cases were settled and dismissed : Cornahan & Co. vb. Holt & Co; Carnahan & Co. vs. C. W. and Amelia Holt; Herman Cohen vs. Victor Volney; Meyerfleld & Canz vs. Lareen & Moor; James Mc- Farlane vs. T. P. Noonan; Catherine Milne vsi John Milne. The following other business was done: August Kynzle vs. J. B. Saarl et. al, trial today. Clatsop Mill Co. vft Elmer Warnstaff, judgment for plaintiff as per stipula tion filed. C. H. Cooper vs. W. P. Dillon, trial set for Thursday. R. L. Bush vs. James Nelsh, con tinued for term. Maria C. Laisen vs. P. J. McGowan & Sons, on motion, removed to U. S. circuit court. Ii J. Ford vs. W, A. Ford, Friday next set for trial. Richard Gordon et. al. vs. Herman Wise, default and Judgment for plain tiff. Anderson Dooney, a, native of Great Britain, wnii admitted to citizenship, V. R. The City of Astoria does ordain ns follows: Section 1. The owners or agents of any property fronting or abutting on nny street Improved by the direction of the common council, or under a per mit authorizing such improvement, shall, when notified by the superin tendent of streets, at their own ex pense, make or cause to be made such local repairs to such street, roadway, sidewalk, or crosswalk,, ns will place the same In good condition. Section 2. Materials used nnd work done shall, ns far as practicable, con form to the provisions of this ordinance or ordinances relating to the Improve ment of such streets, or to the permits granted therefor, and upon the com pletion of the repairs all surplus ma terials shall be immediately removed, nnd the street cleaned up to the satis faction of the street superintedent. Section 8. A failure to comply with any of the provisions of this ordinance shall be deemed a misdemeanor, and upon conviction beforo the auditor and police Judge, the offender or offenders shall be subject to a fine ot not less than five dollars or more than twenty five dollars for each and every offense.
