OPJGIXAL - PACKAGE QUESTION.
The KcwEra, a paper printed in
South Dakota, lias made the discovery
that the "original package" decision
doesn't count in that state. The
reason is because prohibition is in the
state constitution. Congress passed
the enabling actj the people o South
Dakota adopted a constitution -nitha
prohibition sectiona section author
izing the legislature to prohibit the
liquor traffic; the president is
sued his proclamation pursuant to
lav declaring the state admitted to
the Union, irith its constitution, of
course, and the state legislature has
exercised its constitutional power to
prohibit After reciting these facts
the Hew Era exclaims: "CoDgress
and the president make laws for the
supreme court to enforce. Can the
supreme court nullify the constitution
of South Dakota? We think not.
Our constitution must stand superior
to any Dred Scott interstate commerce
opinion of the supreme court, or else
ve are not entitled to statehood."
If a case should arise involving the
points made by the Hew Era, the
supreme court might hold that con
crees by virtually approving the con
stitution of South Dakota had sur
rendered its power to regulate
commerce in liquors between the peo
ple of South Dakota and the people
of other states, or it might hold other
wise. Be that as it may, it is certain
that the supreme court is not bound
by anything and everything that
oougreas and the president may
choose to do, nor is it bound by any
state constitution. If it were, nobody
could complain of the Dred Scott de
cision, for that simply upheld an act
of congress. The court is bound by
tho constitution of the United States.
If congress passes an act which is
plainly in conflict with the national
constitution the court will not up
bold it
Suppose, for illustration, the consti
tution of South Dakota containing a
provision authorizing the state legis
lature to pass laws impairing the obli
gation of contracts, or a law making
every man's due-bill a legal tender in
payment of his debts. The supreme
court would not bo bound by such a
provision, nor would an act of
congress admitting the state to
the union with a constitution con
taining such a provision make the
provision binding upon tho court.

tion of the United States. If the con
stitation of South Dakota contains
anything plainly repugnant to tho
coastitution of the Nation it is void,
and the supreme court will no doubt
bo declare it the matter comes before
it in proper form and manner for
judicial determination."
The house bill to incorporate the
JNorth River Bridge company, which
passed the United States senate June
23th, is a step toward tho connection
of New York city and Jersey city by
the biggest span ever erected. The
bridge will have a capacity for ten
railroad tracks across it, with propor
tionate accomodations for foot-passengers
and wagons. The estimated
cost of the bridge proper including
towers, cable and anchorage is 15,
000,000; approaches of stone and iron
and appurtenances, S11,000,000; inci
dentals, $14,000,000.

It has been rumored that the well
knowa specialists in medicine, the
Drs. Damn have given up practice
here. This is a mistake; but one of
them lias left, he having gone to make
further investigation of surgery in
London ad Paris hospitals. The
balance of the corps have invested
largely in property throughout the
northwest, and will remain here per
manently. Mercury, June 28.

Also 4,633 pkgs salted salmon, the
whole valued at $697,700 against 83,
