A land case invalidating the title to very valuable property adjoining the city limits ot Chelialis has jnsfc been commenced. On Xovember i)th, 1870, Frank Allen, now of Claqnato, made a homestead entry on a quarlerof section 10, township li north, range 2 west. On April IS, 1872, his entry was cancelled, being in conflict with the grant to the Northern PaciGc railway. Several years after F. Donahue bought the land from that company who gave him a warrantee deed." Under the recent decision of Gale va. the North ern Pacific Railway company, on which almost exactly the same state of affairs cxLted, the secretary of the interior has decided in effect that erroneous cancellation does not affect tho rights of the homesteader. Acting under this ruling and in accordance with the law oE March 31, 1SS7, Mr. Allan thinks he has a good right to the land, and has made ap plication before the land office to have Ins entry reinstated. In all prob ability a hearing will be ordered to take testimony on behalf of the par ties on both sides. Should Allen es tablish his claim he can perfect his title under the homestead entry laws. Donahoe lias held the land under the Northern Pacific railway's deed for about 1G years, and has improved it, converting it from a primeval forest into one of tho choicest farms in Lewis county. The land lies adjoin ing Chehali3, between here and (Jen tralia, and is valued at not less than S1G,G00 to 820,000. Messrs. Reynolds & Stewart have the case in hand and are confident they can secure for Mr. Alien the rights which were erroneous ly taken from him twenty years ago. A pecidiar feature of the case is the similarity of Allen's to the successful Gale case. Allen made his eutry on November S, 1870, and Gale only seven days later, and both had their entry cancelled on the same day, April 18, 1872. Mr. Donahue claims that Allen, being notified by the land office that the-laud was a part of tho Northern Pacific laud grant, abandoned his homestead entry and bought it from the railway company, selling it at a later date to Noah Rosworth, who in turn sold it to Donahue, the present owner. Mr. Donahue has spent seventeen years of the best part of his life clearing up the land.
