A PwLion on the Prohibitory Law Which Please Them. LiUvvksw okth. Kan., March '.). Judge Crozier, of the first judicial district of Kansas, in the trial of a drnsgist before him charged with vio lating the prohibitory law. rendered a decision to-day that puts a new pha on the liquor question in this state. The assistant attorney general for tins connt a few weeks ago. legan proceedings against all druggists in this cit. to have them forfeit their ov mits to sell intoxicating liquor, and to have permanent rest raining injunc tions issued against them. The inoe greatly alarmed them at the time, but they got together and resolved to test the law as it applied to their cases. Accordingly one of their number, ICd ward Fritche, was brought to trial to-day, and the evidence in his case showed clearly that he had not required parties to make an affidavit liefore selling them liquor, and that he had violated the law in several other points. The judge icn dered a lengthy decision in the cast, m which he v.ent over all the prohib itory laws passed in the several state, and he quoted from the decision of judge Brewer and others, lie re fused to grant the injunction, and said the only way proceedings could be in stituted against druggists for i iolating the law was by the same method :tr was taken against common saloon keepers or joiutists. lie also held that when a person came to a druggist and got liquor under false preten tions they were the ones to be prose cuted and not the druggists. Certain sections of the law that relates to druggists, he says, are unconstitu tional, and the following aie his quo tations and opinion on it: "If the druggist has reason to be lieve that it is not for the purpose or ailment specified, he must not ;cll. This makes him a plnsiciau. lie must not sell to minors, lie must le a judge of ages. He mnl not sll to drunken men. lie must hae a good nose. Xor to a person in the habit of getting intoxicated. He must know the family history of the applicant. The druggist is put in a separate class. He is liable on his bond where druggists have a lawful permit, and he is punishable by fine and imprisonment, but he is not pun ishable by an injunction and the cae is dismissed." The decision is receh cd with great joy by the druggists who will now proceed to sell liquor in earnest. INCOMING PASSENGER.
