Ouk esteemed contemporary in Portland following the example of its esteemed California brethren, has of late added tbe -word "copyrighted" to sosao of its press dispatches. The imposing cablegram announcing tbe imminence of a general European war is thuslabelcd; the humble special from Goldendale, Skookum Chuck or Squaw Gulch does not share the dis tinction. Two objects are sought in Ike use of this label. One is to im press the reader with the financial re sources and enterprise of the paper; tbe other is to warn off esteemed con temporaries which own scissors. It's all a sham. The "copyrighted" dispatches in none of the newspapers are copyrighted. And besides being a sham the false pretense is an offense punishable by a fine. Witness section 4953, United States revised statutes: Every person who shall insert or im press a notice of copyright on nny article for which ho kits not obtained n copy right, shall be liable to n penalty of one handled dollars, recoverable, onohalf for tke person -who shall buo for snch penalty, aad one half to the use of tho United States. And this penalty attaches to every separate number of the newspaper printed. The pecuniar' risk incurred can be accurately ascertained by mul tiplying the number of items marked "copyrighted" yy tue daily circulation, then by the number of days that tho fraud has been practiced, and the whole by 100. Our reasons for asserting that these so called copyright dispatches are not copyrighted arc ample. In the first place tho records in tho office of the librarian or congress do not, and in the nature of the case cannot, show the 'title pages" of such telegrams, which to comply with the law would have to bo sent to that official after the items had been written and before their publication. Even then the authors would not be entitled to use the word copyrighted" until they had received notice of the entry on record of such "titlo pages." This, in case of the pretended copyrighted Pacific coast telegrams, would require about seven days, whereas these bogus copyrights are published and "copy righted" on Hie same day. Foreign cablegrams cannot be copy righted, because under sections 4,952 and 4,971, United States revised stat utes, the author, composer, writer or makerof the thing copyrighted must be a citizen of the United States and a resident therein. If not, then the composition or writing is free to the whole world. The supreme court of the United States has settled tliis whole matter beyond disputo in Baker vs. Sheldon, 101 United Stales Reports, page 105, in which the court holds that "a newspaper cannot be the subject ot a copyright, because a copyright cannot with any propriety be applied to a w ork of so fluctuating and fugitive a form as that ot n newspaper, the sub ject matter ot which is daily chang ing, and is of mere temporary use, aad the constitution ot tho United States does not extend the power of congress to afford protection by copy right to newspaper." The assumption ot "copyrighted" dispatches has long been practiced in San Francisco. Tho introduction of the custom in Portland will deceive o one acquainted with the facts and the law in tho case. The Canby to-day takes over four propeller blades for the steamer T. J. Coleman, which runs on Shoal water Bay. Tho Signal came in yesterday from tho Sound and went up to Portland. She had on more freight than usual, which shows an increasing business. Tho Mamanita, which went up tho river a few days ago for the purpose of replacing tho stake and beacon lights which were washed away by the recent high water, is expected down to-day. Tho wrecker Whitelaw camo down from Portland yesterday. She is on her way to tho Sound. A mass of old iron and truck was unloaded from her at the Union Pacific dock. Tho offi cers stated that tho boat had consider able work on hand for quite a while in the future. Tho revenue cutter Corwin waB alongside the east end of thoU. P. dock yesterday coaling up. As this is very dirty work and the cutter is a neat boat, canvas was carefully stretched over the exposed places and the coal put in tho bunkers. Tho Conoin has room for about 65 tons.
