They hnve little hope of electing the legislature, but the big fight is to be made for the re election of Pennoyer. WHAT "WIMAN DID. Buffalo, N. Y., Oct. 14. Wm. E. Curtis, manager of the Pan-American excursion, is much excited over the re sults of the Erastus Wiman dinner to the delegates at Niagara Falls last night. Curtis says Wiman was one of the committee on entertainment at New York, and subsequently asked that he be allowed to give the dele gates a dinner at Niagara Falls. Cur tis replied that Blaine's instructions were that no formalities should be en tered in on Sunday during the trip; that the delegates should be allowed to do as they liked on that day. It finally was arranged when Wiman should give a dinner, hut that it should be entirely informal, and that there should be no speeches. Uurtis says notwithstanding this, Wiman left copies of his proposed speech with the newspapers in New York before leav ing. Curtis this morning telegraphed Blaine that Wiman had acted in bad faith. The case came before the secretary on an appeal from a decision by t'ae com missioner of the general land office, which affirmed the action of the local office in rejecting the application, up on the ground that the tract was em braced, at the date with the com pany's rights attached under its grant, within the exterior boundary or claimed limits of certain Mexican private land grants known as the San Jacinto, Viejo and San Jacinto Nuevo; and being, upon final survey smd def inite location of said grants subse quently made, excluded from the lim its thereof and thereby restored to tlie public domain, was subject to homestead entry at the date when appellant's application to enter the same Tvas made. The secretary, in his decision to day, holds that the grants named were "floats" embraced within the outside limits of a larger area, and that if such larger area lies within the limits of said land grant made in aid of tho railroad, such laud grant would take effect, except as to the quantity of land or "float" actually granted in the Mexican grant; aud if that quan tity lying together was left to satisfy the Mexican grant, the railroad com pany would be entitled to patents for the odd sections of the remainder. The action of tlie general land office is therefore affirmed. This decision follows that of the supreme court in the case of tho United States vs. 'McLaughlin, rendered May 14, 1888, anil practically overruled as previous decisions of the interior department in similar cases.
