West Sixth Street Improvement Notice. Xotice is hereby Riven that the Com mon Council propose to order the im provement of that portion of West Sixth street in the city of Astoria as laid out and recorded by J. M. Shively in Clatsop county, OreRon, from the south side of Water street to the south side of Cedar street, by removing all de fective piles, caps and stringers and re places them with new and sound piles, caps and strincers, and by raising it to the established grade, and by planking the same with new and sound fir plank four inches in thickness to the full width of the street, and by building side walks on both sides of said portion of said street. An Ordinance to 1'roilJe for Licensing end necDlatlns Bar-Rooms and Drinking Shops Within The Corporato Limits orTheCitjr of Astoria. The Citv of Astoria does ordain as ' follews: Section 1. That no person or persons I shall in the City of Astoria.Clatsop coun ty, uregon, euuer uireuuy ur imuucliij, in person or ny another sen. uaner or deliver, or knowingly permit to be sold, bartered or delivered, ior or on his or their account, any wine, maltor spiritu ous liquors to be drank on the premises owned or occupied by him or them, without first obtaining a license so to do in the manner in this ordinance hereinafter provided. Any person vio lating any of the provisions of this sec tion shall, upon conviction thereof be fore the Auditor and Police Judge be fined not less than twenty-five nor more than one hundred dollars, and be im piisoncd in the city jail until such fine be paid, not to exceed twenty days. And it is lieieby made the duty of the Chief of Police and of each policeman of the City of Astoria to make com plaint to the City Attorney of each and every person for any violation of the provisions of this ordinance. Sec. 2. Every person applying for a license to sell wine, malt or spirituous liquors under this oidinance in any quantity not less than one quart, shall pay into the city treasury the sum of one hundred dollars for one year, and every person applying for a license to sell wine, malt or spiritous liquors un der the provisions of this ordinance in quantities less than one quart, shall pay into the citv treasury the sum of two hundrcddollars for one year. Provided, that no license shall be issued under this ordinance for a less period than one year, and that suh license shall not be transferable. Sec. 3. Before a license shall issue as provided for in this ordinance the ap plicant shall petition the Common Council in the inatiiitr provided for in Section 4 of this ordinance, and sh.ill also with said petition present to the Common Council a bond in the sum of five hundred dollars with two or more sureties, payable to thi- city of Astotia, conditioned" that he or they will keep an orderly house and will in all things comply w th the provisions of th-s or dinance during the period of one year from tho beginning of such license. Attached to said bond shall be an affi davit verified by the oath of the sureties to the effect that they arc free-holders in the city of Astoria and are in the ag gregate worth the sum of one thousand dollars over and above all just debts and liabilities and property exempt from execution. The applicant Miall present with such bond and petition a receipt of the treasurer for the amount of money deposited for such license. Sec. 4. The petition required by this ordinance shall state: 1st, The name of the applicant. Zd. Whether such applicant lias be fore held or holds at the time of appli cation a license, and if so, at what aate such license has or does expire. 3d. At what dates such applicant de sires sucli license to begin and expire, and the place where such liquors are to be sold. Such petition shall be verified by the applicant or if more than one by at least ono of such applicants, stating that such petition is true. Sec. 5. The receipt of the treasurer mentioned in section 3 of this ordinance shall state that the amount paid by such applicant is paid for a liquor li cense to be refunded in case the Com mon Council shall refuse to grant the petition of the applicant, otherwise upon the issuing of such license to go into the funds of the city. Sec. ft Upon the granting of such petition by the Common Council the Mayor shall examine the bond of the applicant and either approve or disap prove the same. Sec 7. Upon the provisions of this ordinance being fully complied with the Auditor and Police Judge shall is sue such license to sucli applicant. Sec. 8. The bond to be given by the applicant, as provided in tins ordinance, in case of a violation of any of its pro visions and conditions shall he liable to be prosecuted therefor in a civil action, and it shall be the duty of the Auditor and Police Judge of the city of Astoria to prosecute the bond given by such ap plicant, for any violations of its condi tions. Sec. 9. Any keeper of a bar-room or drinking shop who shall permit any breach of the peace or disturbance of the public order or decorum, by noisy or disorderly conduct on the premises, when it is in his or her power to pre vent the same or who shall sell or give any intoxicating liquor to any person already intoxicated, or to any person under the age of legal majority, or who shall allow or permit anj- minor to re main in orabout anybar-room or drink ing shop under his or her control, shall be deemed guilty of a misdemeanor, and upon conviction thereof before the Po lice court, be fined not less than twenty-five nor more than one hundred dol lars, or by imprisonment in the city jail, not less than twelve nor more than twenty days, and shall forfeit the li cense to sucli bar-room or drinking shop. Sec. 10. Any keeper of a bar-room or drinking shop who shall permit or em- Cloy any woman to act as waitress or ar-tender, or to sing or dance, or to serve in any other capacity in such bar room or drinking shop or who shall em ploy any person to sing or dance in sucn bar room or drinking shop, or who shall permit any theatrical or minstrel show, exhibition or concert to take place in such bar-room or drinking shop, or who shall allow or permit any minor to be or remain in any theater or place of amusement in which intoxicating liquors are sold, shall be deemed guilty of a misdemeanor, and upon conviction thereof before the Police court, shall be fined not less than ten nor more than one hundred dollars, or by imprison ment in the city jail not less than five nor more than twenty days, or both, in the discretion of tlw court, and shall forfeit the license to such bar-roomer drinking shop. Sec. 11. Each and every place where any wines, malt or spirituous liquors are sold, bartered or delivered to be drank on the premises, shall be deemed to be a bar-room or drinking shop un der the provisions of this ordinance. Sec. 12. Each and every person hav ing a license under the provisions of this ordinance shall exhibit the same at all times, while the same is in force, in his or their place of business.
