Section 1. That no person or persons
shall in tho City of Astoria,Clatsop coun
ty, Oregon, either directly or indirectly,
in person or by another sell, barter or

bartered or delivered. lor or on his or
their account, any wine, maltor spiritu
ous liquors to be drank on the premises

uititout first obtaining a license so to
do. in the manner in this ordinance
hereinafter provided. Any person vio
lating any of the provisions of this sec

Seo.2. Every person applying for a
iin-iiac iu sen wine,, man or spirituous
liquors under this otdinance in any
quantity not less than one quart, shall
pay into tho city treasury the sum of
one hundred dollars for one year, and
every person applying for a licence to
sell wine, maltor spiritous liquors un
der the provisions of this ordinance in
quantities less than one quart, shall pay
into the city treasury the sum of two
hundreddollars for one year. Provided,
that no license shall be issued under
this ordinance for a less period than
ono year, and that such licence shall
not be transferable-,
Sec. 3. Before a license shall i-sue as
provided for in this ordinance the ap-
elicaut shall petition tho Common
ouncil in the manner provided for in
Section 4 of this ordinance, and shall
also with said petition present to the
Common Council a bond in the sum of
five hundred dollars with two or more
sureties, payablo to the city of Astoria,
conditioned that he or they will keep
an orderly house and will in all tilings
comply with the provisions of tlrs or
dinance during the period of one vcar
from the beginning of such license.
Attached to said bond shall be an affi
davit verified by the oath of the sureties
to the effect that they are free-holders
in the city of Astoria and are in the ag
gregate worth the sum of one thousand
dollars over and above all just debts
and liabilities and property exemp:
from execution. The applicant shall
present with such bond and petition a
receipt of the treasurer for the amount
of money deposited for such license.
Sec. 4. The petition required by this
ordinance shall state:
1st. The name of the applicant.
2d. Whether such annlicant lias be
fore held or holds at the time of abdi
cation a license, and if so, at what cute
such license has or does expire.
3d. At what dates such applicant de
sires such license to begin and expire,
and the place where such liquors are to
be sold.
Such petition shall be verified by the
applicant or if more than one by at
least one of such applicants, stating
that such petition is true.
Sec. 5. The receipt of the treasurer
mentioned in section 3 of this ordinam-e
shall state that the amount paid by
such applicant is paid for a liquor li
cense to be refunded in case the Com
mon Council shall refuse to grant the
petition of the applicant, otherwise
upon the issuing of such license to go

Sec. C. Upon the crantinc of such
petition by the Common Council the
Mayor shall examine the bond of the
applicant ana eitner approve or airp
prove the same.
Sec 7. Upon the provisions of this
ordinance being fully complied with

Sec. 8. The bond to be given by the
applicant, as providedin this ordinance,

visions and conditions shall be liable to
be prosecuted therefor in a civil action,
and it shall be the duty of the Auditor
and Police Judge of the city of Astoria
to prosecute the bond civen by such ap
plicant, for any violations of its condi
tions. Sec. 9. Any keeper of a bar-room or
drinking shop who shall permit any
breach of the peace or disturbance o'f
the public order or decorum, by noisy
or disorderly conduct on the premises,
when it is in his or her power to pre
vent the same or who shall sell or give
any intoxicating liquor to any person
already intoxicated, or to any person
under the age of legal majority, or who
shall allow or permit any minor to re
main in or about any bar-room or drink
ing shop under ins or hercontroI,shall he
deemed guilty of a misdemeanor, and
upon conviction thereof before the Po
lice court, be fined not less than twenty-five
nor more than one hundred dol
lars, or by imprisonment in the city
jail, not less than twelve nor more than
twenty days, and shall forfeit the li
cense to such bar-room or drinking
shop.
See. 10. Any keeper of a bar-room or
drinking shop who shall permit or em
ploy any woman to act as waitress or
bar-tender, or to sing or dance, or to
serve in any other capacity in such bar
room or drinking shop or who shall em
ploy any person to sing or dance in
such bar room or drinking shop, or who
shall permit any theatrical or minstrel
show, exhibition or concert to take place
in such bar;room or drinking shop, or
who shall allow or permit any minor
to be or remain in any theater or place
of amusement ih which intoxicating
liquors arc sold, shall be deemed guilty
of a misdemeanor, and upon conviction
thereof before the Police court, shall be
fined not K'ss than ten nor more than
one hundred dollars, or by imprison
ment in the city jail not less than five
nor more than twenty days, or both, in
the discretion of tha court, and shall
forfeit the license to such bar-room pr
drinking shop.
Sec. 11. Each and every place where
any wines, malt or spirituous liquors
arc so!d, bartered or delivered to be
drank on the premises, shall be deemed
to be a bar-room or drinking shop un
der the provisions of ibis ordinance.
Sec. 12. Each and every person hav
ing a license under the provisions of
this ordinance shall exhibit the same at
all times, while tho same is in force, in
his or their place of business. Any per
son violating tho provisions of this sec
tion shall upon conviction thereof be
lore the Police court bo fined not to ex
ceed fifty dollars or by imprisonment
till such fine is paid not to exceed twen
ty days.
Sec. 13. That ordinance No. 870, en
titled "An ordinance amending section
2 of ordinance No. B87" approvfd De
cember 23d, 1885, and ordinance Xo. 872,
entitled "An ordinance providing for
the execution of a bond by any one
wishing to obtain a license to sell spir
ituous liquors," approved January 20th,
1880, and ordinance No. 952, entitled
'An ordinance amending ordinance
No. 587, entitled an ordinance to pro
vide for licensing and regulating bar
rooms and drinking sheps within the
corporate limits of the city of Astoria,
Clatsop county, Oregon, approved No
vember 10th, 18SG, and ordinance No.
587, entitled "An ordinance to provide
for licensing and regulating bar-rooms
and drinking shops within the corpor
ate limits of the city of Astoria, Clatsop
county, Oregon," approved February
29th, 1884, bo and the same are hereby
repealed.
