mittee on elections made a favor
able report on -Hilton's bill to lo
cate the county seat of Gilliam
county by special election in May,
Condon and Arlington to be. voted

Norvel moved to take up repre

of the Wallowa county wagon
road. The motion prevailed and
the bill was read the third time

Oolonel Knsssll's Quandary.
During our November court,
Hon. D. A. Russell, an able, excit
able lawyer, defended Sandy
Banks, negro, for assault to mur
der a negress. Solid facts were
against his client, no justification
appearing. After dodging the
criminating facts as best ho could,
he, in low, confidential tone, closed
with this stirring appeal to induce
the jury to find a lesser crime:
"Gentlemen: 1 do not ask you
to acquit my client. It would be
wrong in me to do so. I as : for
mercy. 'The quality of mercy is
not strained; it dropped as the
gentle rain from heaven upon the
plain beneath. It is twice blessed:
it ble-ses him that gives and him
that takes.' What a beautiful at
tribute is mere) ! Did you ever
think about it? Why, gentlemen,
without mercy there would be no
charity; without charity there
would be no friendhip; without
friendship there would be no love;
without love there would be no
religion; without religion theie
woull be no God; without God,
gentlemen of the jury, where iu

The climax brought out a rins
ing laugh, the cause ot which the
fpeaker could not see until his ir
reverent remark was explained to
him. The jury found no mercy
in the case.
