Act to authorize the Astoria and South Coast Railway company to construct a bridge across Young's bay and Skipanon creek in the county of Clatsop in the state of Oregon. He it Enacted by the Legislative Assembly of the State of Ore Ore eon: Section 1. That it shall be lawful for tho Astoria and South Coast Railway company, a corpo ration duly incorporated and ex isting under the laws of the stato of Oregon, or its assigns, and that said corporation, its successors or assigns bo, and it and they are hereby authorized and empowered to construct, build, maintain, use and operate, or cause to be con structed, built, maintained, used and operated a bridgo across Young's bay, a navigable stream in said county and state, from Smiths point to some point on tne west side of said Young's bay as may bo selected by said company, with channel spans, draws, safe guards and auxiliary works as shall cause tho said bridge not un duly to obstruct or injure the nav igation of the waters crossed by it; also to construct, build, maintain, use and operate, or cause to be built, constructed, maintained, used and operated a bridgo across Skipanon creek, in said county and state, by permanent embank ment or otherwise as may bo ap proved by three competent and qualified commissioners to be ap pointed by the county court of the stato of Oregon for Clatsop coun ty, for the purpose of travel or commerce as a railroad. Said bridge across said Young's bay to be constructed of iron and wood. or iron, wood and stone, and shall be deemed a lawful .structure, and there shall be placeil in said bridge a draw of such width as shall be determined by the commissioners as aforesaid, leaving a passage way through said bridge as to allow easy pas sage way for all vessels either team or sail, of such width as may be determined by the said com missioners, said draw and passage way shall not, however, be less than seventy-fiye feet in the clear; and to secure that object the said railway company, its successors or assigns shall submit to the said commissioners for examination and approval, a design and drawing of such bridge across Young's bay, and a map of Young's bay from the mouth of its navigable tribu taries to the adjacent ship channel, which said map shall be on a scale of at least one to twenty thousand, and whose topography of the shores and hydrography shall rea sonably represent the banks, the bottom and steamboat channels by contours of six feet, and which shall be accompanied by other maps, drawn to a scale of one inch to two hundred feet, giving, with areas of one fourth of a mile from each draw span, an accurate rep resentation of the bottom of the bay by contour lines two feet apart, determined by accurate soundings, and also showing the force and direction of the currents at each two feet of tidal stage, by observation on suitable floats; also showing Skipanon creek to the head of usual navigation. The maps shall also show the location of all other bridges, if in the vi cinity, and shall give such other information as the said commission ers may require for a full and sat isfactory understanding of the subject; and which said maps with the approval of the said commis sioners endorsed thereon shall bo 61ed in the office of the secretary of this state, to be by him pre served and kept for future and public reference. Seotion X. The legislative as sembly of this stato" shall have the right and power at any timo to prescribe such rules, regulations and rates of toll for transit and transportation over said bridge and the management thereof as may te deemed proper and reason able, v . .- Seotion 3. That on the filing of an acceptance of the terms of this act by the said corporation in the offioe of the. secretary of state, signed by its. president and attest ed by its secretary, and upon en tering into an agreement with tho state of Oregon by the sjtid cor poration that in tho construction of the said bridgo and bridges, or either of them, none but white la bor shall bo employed, which agreement shall be filed with the secretary of state, and upon enter ing in good faith upon the work of constructing said bridges by the said corporation or its success ors or assigns within one year from the passago of this act, and com pleting tho same within two years from tho taking effect of this act, tho rights specified herein shall be deemed and become a vested fran chise; provided, that if said cor poration, its successors or assigns shall fail to comply with the pro visions of this act within the time specified for tho commencement of the construction of said bridges in good faith all its rights under this act shall be deemed waived and forfeited.
