Ordinance No. 1048 as Amended
An ordinance regulatingand prohib-
iuuk iiuiujuis iium running at large
within the limits of the city of Asteria:
The City of Astoria does ordain as
follews:
Section 1. No horses, mules, cattle,
sheep, swine, or goats, shall be allowed
to run at large or be herded in any of
the streets, alleys, parks, or public
places in the City of Astoria during any
of the hours of the day or night, except
when being driven through for ship
ment or other purposes as hereinafter
provided, unless the owner or owners
of such animal or animals shall first ob
tain permission of the owner or agent
of the premis es on which or in trout of
which it is proposed to feed such ani
mal, and then and in that case such an
imal must bo securely fastened with a
rope in the hands of some person suffi
ciently able to manage and control such
animal.
Sec 2'. Any of the animals described
in section 1 of this ordinance found run
ning at large within the limits of the
city, except as provided in sections 1, 2
an-1 3, -may be taken up by any police
officer or by any person and impounded
in a pound or enclosure to be provided
therefor; and such animal shall be
provided with proper care, food and
water while so confined.
Sec. 3. The Chief of Police shall give
immediate notice by posting written or
printed notices in three public places
within said city describing such animal,
and stating that if the owner does not
appear and pay costs and charges of the
seizure and keeping such animal, within
three days from the date of the notice;
that the animal will be sold at public
auction at a time and place to be speci
fied in the notice, which notice must be
dated of the date of posting the same.
Sec 4. The owner or owners of any
animal or animals so impounded may
appear at anytime after the seizure and
upon paying the costs and expenses of
keeping such animal, to wit: tho sum
of one dollar per day while so impound
ed, and a further sum of one dollar as a
fee for impounding the animal, shall be.
entitled to receive such animal, and all
sums so paid shall go to the Chief of Po
lice, or such person as lie may authorize
to impose this ordinance as hereinafter
provided.
Sec. 5. The Chief of Police may, by
writing appoint a person to seize, take
possession of and keep, as herein pro
vided, all animals found running at
large contrary to this ordinance, and
such appointment, when made, shall be
filed in the office of the Auditor and
Police Judge of said city.
Sec. G. If at the expiration of the no
tice, provided for in section tluee of
this ordinance, no person has appeared
aud paid tho costs, charges and fee for
impounding such animal, it shall be
the duty of the Chief of Police to pro
ceed and sell such animal, at the time
and place in such notice specified, at
public auction to the highest bidder for
cash, and retain from the proceeds of
such sale the amount of said costs, ex
penses and fees, and the overplus, if
any there be, shall be paid into the city
treasury, and the Common Council, up
on receiving satisfactory evidence of
ownership ot sucli animal or animals.

Sec. 7. When any animal is im
pounded under this ordinance, if the
owner or owners thereof be known, a
copy of the posted notice shall be per
sonally served upon such owner or
owners if lie reside within the limits of
said city, but if .such owner reside out
side, the city limits he may be served by
mail.
Sec. 8. Whenever any animal is
sold under this ordinance the Chief
of Police shall make a report showing
his proceedings in full in 1 elation to
the matter, which report shall be tiled
in the office of the Cit Auditor and Po
lice Judge.
Sec 9. The sale of an animal under
the provisions of this ordinance shall
operate to coney unto the purchaser a
lull, absolute and complete title to such
animal.
Sec. 10. It shall be unlawful for the
owner of any animal to permit the same
loweara oeu within tne city limits;
mil the owner of such animal, unnn
ronviction thereof in Police Court,
shall be lined not to exceed one hun
dred dollars, or by imprisonment not to
exceed twenty days, or both, in the dis-
cielion of tliejAuilitorand Police Judge.
Sec. 11. That ordinance No. JO'I, enti
tled "lo prevent animals from lunnnig
at large within certain limits within
the City of Astoria." annroed March
2;:rd, 1881, be and the same is hereby
repealed.
Sec 12. It shall bo the duty of the
Chief of Police nnd eacli roliceman and
Captain of Police to cnfoice the pro
visions of this ordinance, and any of
ficer knowingly failing so to do shall he
liable to removal for such neglect.
