of the reversal by secretary Lamar
of the decision of the commission
er of the general land office in the
case of the Northern Pacific rail
road company vs. James T. Elder,
Edgar Percival and Walter S.
Bower. This is a claim for land
in section 7, township 20 north,
range 3 east, Olympia district
Washington territory, claimed by
this compay under its grant and
by defendants under their respect
ive applications to enter and pur
chase said land under the general
land law.
Decision of the case depends
upon two issues therein presented,
to-wit:
First Whether the Northern
Pacific railroad company has a
grant of lands for that portion of
its road from Portland to lacoraaj
and second, was the tract in con
troversy land to which the United
States had full title, unappropri
ated and free from pre-emption,
homestead or other claims or right
at the date of definite location of
the load opposite said tract. The
first issue the secretary decides in
the affirmative, the tract in contro
versy adjoining the city of Ta
coina. Touching the second issue
secretary Lamar rejects the ap
plications of defendants to make
entry of the tract, and awards the
same to the railroad company.
In the decision of the commis
sioner of the general land office in
a similar case, that of the North
ern Pacific Railway company vs.
Donald McRae and James L.
Brooks, involving land in section
5, township 20 north, range 3 cast,
Olympia, W. T., applications to
make entry by defendants were
rejected by the local officers be
cause said tract is within the li'nits
of withdrawal for the benefit of
the railroad. The commissioner
reversed the decision of the local
officers, solely upon the ground
that the company has no grant of
land for that portion of its road
from or at a point in the valley of
the Columbia, cither at or near
Portland, Or., to Puget &oumI in
Washington territorj'. Secretan
Lamar reverses the action of the
commissioner in question, and says
that he is clearly of the opini n
that the Northern Pacific Rai'v.a;.
company has a grant of land in m
Portland to Pugetsound (Tacoma),
and the action of the local land offi
cials is therefore sustained.

What a picture of one woman's
life is given by the boy's artless
description of his mother's work in
the following anecdote. It would
be humorous but for the sugges
tion of hard fact and dreary unap
preciation which is depicted, and
finds an echo in more than one
household, we regret to say:
"My mother gets me up, builds
a fire and gets my breakfast and
sends me off," said a bright youth.
"Then she gets my father up and
gets his breakfast and sends him
off. Then she gives the other
children their breakfast aud sends
them to school; and then she and
the baby have their breakfast."

Trying to Save Their Necks.
Chicago, Oct. 2. The very last
remedy within the scope of legal
ino-enuitv to save the anarchists
from hanging was in process of
preparation to-day. When fin
ished it will be a petition upon
which the supreme court of the
United States will be asked to is
sue a writ of error and stay of ex
ecution in the cases of the con
demned men. This document is
being prepared by Captain Black
and attorney Moses Solomon, and
involves a stupendous amount of
hard work. They will have to
read and with the closest atten
tion, too some 2,000,000 words
which make up the proceedings of
this famous trial.
Out of this wilderness of words
will be culled every scrap, item,
remark and ruling, every state
ment of the counsel for the state
that may be deemed to have had
an unfair bearing upon the issue,
and the labor of the extraction of
these points from the record and
putting them in legal shape will
require a week or ten days, ana
will keep both lawyers 'busy all
the time. While these gentlemen
are at work on the petition a force
of type-writers is kept busy at Ut
tawa, getting up a copy of the rec
ord. It is intended to work thirty
type-writers at one time and to
make all haste to finish the job at
the very earliest moment. A copy
of the Ottawa record will cost the
defense committee 4:,000.
