A man natnedJatnes Gallagher, employed as a sheep herder on the San Luis ranch on the west side of the San Joaquin river, in this count-, was killed Monday by a Frcnohman known as Louis De&moines. Both men had, to outward appearance, been good friends during their so journ on the ranch until Monday, when, during an argument as to the respective capabilities of each other as shearers, a war of words was indulged in, but no blows were struck. Gallagher, seeing a pistol in the Frenchman's pocket, sarcastically -asked what he used a popgun that size for. Desmoines replied that the weapon, which was a thirty-eight caliber Smith & Wesson, was lor the purpose of killing coyotes. Gallagher ex pressed his contempt for toy pis tols, and declared Desmoines could shoot at him a distance of one hundred yards all day without danger to him. Illustrating the proposition, he walked away and when about one hundred yards distant, turned around, facing Desmoines, and called to him to shoot. Desmoines replied by firing a bullet into tho heart of Galla gher, who fell dead on the spot. Constable Bitter, of Central Point, brought Desmoines here and placed him in jail to await a pre liminary examination.
