Two cases of the United States ' vs. Weidler & Ordwav came up in the United States circuit court on the 7th, says the Oregoniun on demurrer to the defense. The first case was brought to re cover 72,000 for timber cut on the lands of the United States and brought to Portland and converted into lumber. The second was to recover $7,500 for timber cut on the same lands and made into cord wood. The defendants set up two defenses one that the land was the property of the Northern Pacific railway company, being a part of the giant of the government to that company on the route of its road between Portlindand Wallu la Junction and that they cut the timber thereon by the leave and consent of said company. The becond defense was that, however it may be as to whose the land is, they cut the timber in good faith, believing that the land belonged to the company, and therefore, not being willful tres passers, thoy ought not to pay any more than the value of the timber in the tree. There was a demurrer to these defenses by the plaintiff. The demurrer was sustained as to the first defense on the ground that the company had no such right or interest to any section of the land included in its grant prior to the construction of the road opposite thereto as authorized it to waste or despoil it by disposing of the timber thereon. It was overruled as to the second defense on the ground that if the parties acted in good faith, as the- alleged, they were not liable for any more than the value of the timber in the standing tree. The Interstate Oommission. New York, March 7. A Wash ington dispatch says: It can be said on high authority that three members of the interstate com merce cemmission are absolutely decided upon. The president is in doubt regarding the two remain ing selections. William R. Mor rison has accepted the tender of the commissionership, and prob ably will be the chairman of the commission. Judge Cooley, jof Michigan, receiver of the Wabash system, and General Bragg, of Al abama, will also be commissioners. The former is a Republican,, and one of the ablest jurists of the country. It seems a reasonable construc tion that the constitution gives the president ten days in every case to consider all bills before acting on them, and this without reference to whether congress continues in session or not. It also gives con gress the right to override the veto if he makes it in the ten days, but congress may waive that right by an earlier adjournment. They thereby simply leave the fate of the law in the president's hands. They cannot by adjournment waive the president's right, however, to ten days' consideration. The presi dent is always in session. lie never adjourns even to take a drink now-a-days. The consti tution provides that all the grant ed legislative powers shall be vested in the congress of the United States. It provides there by that their concurrence makes a law after the president signs it. The only condition is that the president shall consider it ten days. If he approve it he shall sign it. It would seem a reason able construction, therefore, to hold that if the president sign it within the ten days (even after ad journment) it will be a law. It would be a law after the ten days in that case also without his sig nature, were it not for the express inhibition of the constitution that in the last named case it should not be a law. Democrat.
