-l.V INTERESTING QUESTION.
Astoria is never -without a
question of some kind on which
there is a difference of opinion.
Ever since the city was unwisely
divided into two school districts as
the only way seen to get rid of an
unpopular school teacher, there is
confusion and trouble and "ques
tions" of great and pressing im
portance at the time, and pres
ently forgotten in the greater an d
more pressing importance of the
question that is sure to come up
the week or month after.
The present question is regard
ing the vote in the matter of plac
ing O. Sovey in the city council.
Of five councilmen he received the
affirmative votes of three. The
mayor gave it as his decision that
Mr. Sovey was not elected; that
the election of a councilman by
the council was something that re
quired a majority vote of the en
tire council. Public opinion is
divided as usual.
The case is an interesting one,
in the abstract. On a former oc
casion when Mr. Gilbert was given
three votes for councilman, the
mayor declared him elected. A
question arose as to the legality of
his election. One of the foremost
lawyers in the state and a man
who is to-day the most prominent
candidate at Salem for U. S. sen
ator, was consulted about this
matter. His opinion is alleged to
have been substantially as follews:
that a councilman elected in Asto
ria by three votes of councilmen
could serve provided no one
raised any objection to the legality
of any ordinance passed or de
feated by his vote; that any objec
tion to such vote on the part of
any voter in Astoria would render
any action of such elected council
mah of no effect.
Of more recent date is the sim
ilar election of F. J. Taylor, by
three votes of the city council to
fill an existing vacancy. "When
the estate of Peter Grant brought
suit against the then city council
for alleged negligence, and when
the case was being argued before
Judge Bennett holding court in
this city, Mr. Taylor pleaded, as
a defense against any individual re-'
sponsibility in the matter, the fact
that he was elected in such a man
ner and argued that that should
be sufficient grounds for his being
omitted from the list of defend
ants. Judge Bennett held in sub
stance that as Mr. Taylor had
qualiGed before the auditor and
clerk, had taken the oath of office,
and had taken part in the regular
deliberations of the council that
his argument constituted insuffi
cient defense, and refused to al
low the plea.
At the close of the vote last
Thursday evening the mayor de
cided that Mr. Sovey was not
elected. On a similar occasion
prior, the mayor derided that Mr.
Gilbert was eleetr-d. "WIjimi emi
nent jurists at hotiK' and abroad
differ in their opiniens: when able
lawyers reach ai-tiy opposite
conclusions; when t!.- elii.-f muni
cipal officers of a city, .it different
times make decisions diametrically
opposed to each other it tends to
bewilder the average mind. If
Mr. Sovey or anybody else is en
titled to the honorable position of
, a seat in the Astoria city council
'he should have it. No man should
be deprived of anj' rights, person
al or acquired that of right belong
to him. If the legal opinion re
ferred to above be correctly re
ported it would appear that in
case Mr. Sovey were to be admit
ted to the council and took part
in its transactions that any vote
of his would be subject to objec
tion on the part of whosoever de
sired, thus raising the question of
the validity of such municipal ac
tion. It is to be regretted that
there was not one more vote eith
er in the affirmative or the nega
tive so as to avoid all this dispute,
but as -we seem bound to have a
quarrel of some kind on hand all
the time, perhaps this is as good a
question as any. If it wasn't this
it would be something else.
It is surprising that so sensible
a journal as the Oregonian should
endorse by publication in its edi
torial column the silly talk of
eastern papers concerning a possi
bility of the Chinese government
making our government "pay
roundly for every queue that is
lifted in Washington territory."
Those who never feel satisfied un
less they have a small stock of
worries on hand, can not add this
to their supply. In no case, what
ever lengths the violence may as
sume, can or will our government
be held responsible. The United
States government wouldn't nor
needn't pay England if English,
or Irish, or Scotch, or Welsh, were
killed in this country, nor Ger
many if Germans were killed; nor
France, if French were killed.
Our government should, and
doubtless will, try the marauders
in the U. S. courts, and if found
guilty, punish them. That is all.
The Astoriax thinks just the
way it did last month and last
year and the year before, that the
Chinese are a nuisance and a
menace; that they should not be
here; that their presence is a
blight, and that the only way to
make them go is to refuse to em
ploy them. As long as we give
them reason they will stay. When
ever we make it unprofitable for
them to remain they will go.
"Cattle have increased more
than three-fold in the Pnited
States during the past ten years,"
says the Shoe and Xcathcr Jie
2)orto which adds: "Ours is the
greatest cattle producing region
on the globe. On farms there are
now about forty-two million; on
ranch and range property west of
of the Mississippi about ten mill
ion cattle sraze."
The speech of United States
Senator George in Mississippi &
few days ago, is attractinc; much
attention from southern Demo
cratic newspapers. His position
was that the south must stand
solidly by the Democratic party,
if it expects to exert a controlling
influence in the government of
the country in the future.
The importance and value of
the tobacco crop in Virginia is
very clearly shown in the state
ment of the Lynchburg Advance
that Lynchburg pays more revenue
into the United States treasury,
on the single article of tobacco,
than any one of the New England
states pays on everything it pro
duces. Washington" telegrams indicate
that snivel service reform is meet
ing with disaster, and that first
class offices are rapidly passing
into the hands of the Democracy.
The mugwumps and the truly
good see very little to be thankful
for at the coming Thanksgiving
da'.
The newspapers of the state ut
ter an almost unanimous endorse
ment of John H. Mitchell for U.
S. senator. Should he be elected
Clatsop county would have a friend
at Washington.
Oregon trout are to be procured
for the purpose of stocking the
streams in New York state.
