THE LAWS DELAY.
The most interesting topic
touched upon at the recent meet
ing of the American bar associa
tion was that of "the delay and
uncertainty in judicial administra
tion," which formed the subject of a
carefully considered report of the
Teteran legal reformers David Dud
ley Field and Judge John F. Dil
lon. The conclusion arrived at
by these gentleman was that the
delay and uncertainty referred to
could be materially lessened by
the adoption of the following
among other principles and meas
ures: 1. Allowing summary judg
ment upon negotiable instruments
unless when the defendant is per
mitted by order based on affidavit
to interpose a defense.
2. Making the methods of pro
cedure simple and direct, and do
ing as much as possiblo out of
court.
3. Shortening trials before
ODurls by the enforcement of
stricter discipline and closer ad
herence to the precise issue in
volved. ' 4. Limiting the duration of
trials before referees.
5. Limiting the grounds for
postponements of trials.
G. Imposing penalties for the
introduction of irrelevant matter
into the records.
7. Limiting the time within
which motions for or against pro
visional remedies must be de
cided. S. Restricting the granting of
new trials to cases where it is ap
parent that injustice has been
done.
9. Appointing temporary judg
es to dispose of business left un
finished at the adjournment of
courts of first instance.
10. Limiting appeals to courts
of last resort in cases where they
adjourn for a term, leaving unfin
ished business.
11. Shortening the time within
which appeals should be allowed.
12. Using greater care in the
selection of judges.
13. Reducing the law itself, as
far as possible to the form of a
statute.
14. The collection and publi
cation of statistics of litigation, to
the end that people may know
what business is waiting to be
done.
To the mind of the ordinary
layman it has long seemed that
much, if not too much of the work
of the courts has to be redone.
Vast sums of money are spent
yearly in procuring retrials in the
courts of first instance and reviews
in the appellate courts. Whatever
the fact may be, the presumption
is, speaking generally, that such
reviews and retrials are necessary,
either because of an imperfect ap
prehension of the law on the part
of the judge of the first instance,
or on account of an improper ap
plication of the law to the facts
in the case before him. In most
cases probably no real necessity
for a retrial or a review is found
to exist; but be that as it may, re
views are sought for at the ex
pense of time and treasure of liti
gants and of the state. The way
to guard against such delays as
arise from the causes mentioned,
which are perhaps as influential
as any in promoting delay, would
seem to lie in the direction of in
creasing the powers of the courts
of first instance, and - elevating
their personnel and in limiting the
right to retrials and appeals.
"With men of high attainments
on the benches of our courts of or
iginal jurisdiction much of the nec
essity for appeals and new trials
might be regarded as done away
with. Of course an appellate or
ganization would be necessary, if
for no other Teason than to main
tain uniformity in the law. But
the confidence felt in original
courts of high character would in
great part relieve the pressure on
the courts of last resort. Such a
line of- policy as that indicated
would, without doubt, excite a very
vigorous opposition among those
interested in prolonging litigation,
and might even excite the anxious
criticism of many not thus inter
ested, but it would, we think, com
mend itself to the great mass of
disinterested citizens. From time
immemorial it has been recognized
that it is to the interest of the
state that there should be a speedy
end to litigation. It is of more
importance that judicial business
should be put in train to be done,
that disputes should reach a speedy
settlement, than that any particu
lar set of legal conceptions should
be polished to the last stage of
refinement. This is the view that
is taken by the people at large, as
is seen in the popularity of meth
ods of arbitration. It is also that
favored (theoretically) by the poli
cy of the law, though it is often
widely departed from by some of
the ministers of the law. The nec
essities of the time demand a clos
er realization of the principle in
practice than it has hitherto been
possible to secure.
Russia proposes a conference
of embassadors of the ICuropean
powers at Constantinople, for the
settlement of the Roumelia ques
tion "on the basis of accepting the
union of Bulgaria and Roumelia
as an accomplished fact." The
generosity of this proposition is
remarkable. "My friend Bulgaria,
here, has stolen your pockctbook,"
says Russia to the Turk. "Now I
propose that my other friends, En
gland, Germain', and one or two
more, shall come in and settle the
trouble between you amicably
on the understanding that Bulga
ria shall keep the pockctbook. If
you don't agree to this lair basis
of settlement, we will all turn and
thrash you until you are ready to
give up your watch, coat, hat, and
boots as well' The world has
never, or hardly ever, heard, even
from Russia, anything m statecraft
more purely equitable than this.
