fz) he gaUg ltoratt. ASTOBIA, OREGON: FRIDAY SEPTEMBER 4. 1SS5 NO PUNISHMENT FOR CASTING AWAY A VESSEL. A most peculiar jury trial has just been ended in Boston. It is peculiar principally on account of the verdict There seemed, says tho Maritime Register, to be no doubt of tho guilt of the accused. There was nothing to be offered in mitigation of the of fence charged. It was a serious crime and a severe punishment ought to be meted out to the guilty parties. A ship master and others were charged with casting away a vessel the brig Mary Celeste, of Boston while on a voyage from Boston for Hayti, with the intention of defrauding the un derwriters. At the end of a long trial, in which much damaging facts were brought forward, the jury dis agreed, seven being for conviction and five for acquittal. It came out after the trial that tho jury disagreed, not as to the main charges, but be cause they were afraid of the penalty imposed by the law for the crime charged. Had a verdict of guilty been brought in, tho judge would have had no alternative but to sen tence the ship master to be hanged. In these days such a sentence would be considered barbarous in the ex treme. That a man shall be hanged for murder is considered just, but that a crime against property should receive the same punishment is revolting to all sense of right and justice. The German tribes allowed even murder to be settled by money compensation instead of death. But in these days of boasted civilization and in this land of equality and enlightenment, we are only satisfied with the sac rifice of a life as amends for de struction of one kiud of properly. The law has so stood on our statute books for years. It is among the last of tho savage laws of the earlier mar itime nations, which considered of fences against properly of greater moment than those against the per son, and it forms one of those navi gation laws which many good peo ple are so violently opposed to hav ing changed. No law apparently could give great er surety to underwriters and ship owners that a vessel would not be willfully cast away than than before mentioned. Conspiracy to destroy property at tho risk of being hanged does not apparently offer temptation enough. And yet marine underwrit ers know to their cost that conspira cies wilfully to cast away vessels are common occurences. They have been swindled into paying for such losses time and again. They have appealed to the law, but it is now quite evident from the result in iho Mary Cilesle case, and in previous cases of a simi lar kind, that tho law, savago and extreme as it is, affords them no pro tection. There is practically no pun ishment in this country for casting away a vessel. If a man is found guilty of the act he must be sen tenced to be hanged, but, knowing what tho penalty is, it is highly im probable that any jury would bring in a verdict of guilty, how strong soever the evidence might bo against the accused. A jury would not even run the risk of throwing the accused upon the mercy of tho court. This law, therefore, which should not so long have disgraced our statute books, is made useless by its very severity, and instead of being a protection against fraud, leaves a way open for robbing underwriters for which they have no redress. About two years ago a bill was in troduced in congress to repeal sec tions 0,305 and 5,3GG revised statutes, which contain the death penalty for casting away a vessel, but, as it re lated to shipping, congress took no interest in the matter, and the bill was pigeon-holed. Few people know of this peculiar law, and of those who did, several considered it a dead let ter which would not stand in the way of reasonable punishment of guilty parties. Tho Mary Celeste case, however, has probably convinced them to the contrary. If the jury in that case had brought in a verdict of guilty, without being influenced by the penalty, and the judge had passed sentence under tho law, it is probable then that tho country would have boon horrified at tho barbarity of the sentence and would have petitioned the president for a pardon for the condemned and insisted upon the next congress repealing so monstrous a law. It is to be hoped that so ex treme a case will not bo needed to bring about a reform in the matter. At the next session of congress a bill will be introduced asking for the repeal of this death penalty law. This bill will be supported by un derwriters and others. As it will remove the penalties mentioned in sections 5,365 and 5,366 revised stat utes, and will provide for proper punishment for those who cast atvay vessels, there is no reason why congress should not pass it without delav. Under a Bepublican administration the policy since the resumption of specie payments has bean to hold a reserve of only 40 per cent of the outstanding legal tender nole3, which would be about $13S,000,000, and just as fast as money accumulated above this reserve calls for bonds were is sued and interest on the debt stopped. Treasurer Jordan gives as a reason why he makes no bond calls that he fears gold would be asked for and drawn from the treasury for the pay ment of such called bonds, and he prefers to let the revenues accumu late in the treasury vaults until con gress shall decide whether or not it will do away with the present silver, which he regards as a dangerous el ement in the finances of tho country. He thinks tho saving which might be canceled is more than offset by tho advantages of retaining gold in the treasury. Cabii Yon Lowekfas, stenographer and acting secretary of the South American commission, says: "In many of those countries the United States was not known among the common people. They know Eng land, France and Germany, but the United States suggests to their minds about as much as do Iceland or Malta. The two states which re ceived us coldly were Venezuela aud Chili. Tho latter is the vainest laud I ever got into. Tho Chilians think they could whip the United States without any difficulty. In Costa Rica, Buenos Ayres, Guatemala, Ecuador and Peru, wo were received with open arms. All those countries favor adopting an international silver coin age. Most of them favor our stand ards. In all these states and in all their principal cities there are En glish and French bazars, but no rep resentative American shop, except in Valparaiso. Secketarv Manning has been forced to concede honesty and ability to Bepublican officials. In a recent conversation he is reported as saying 'Tm very much surprised to find so many bright, capable men in tho treasury department. "Why, I meet them by tho score every day, sharp as briers, and with the details of their duties at their tongues' aud fingers' ends. From what I have heard I really expected to seo a great deal of incompetency and corruption in this place. It appears, however, that th-j efficiency of tho service has been growing better and belter every 3'ear, until it is astonishing how per fect the machinery is."
