Libby and Arlbnr Patty were partners iii the sash and door business at that place, whero they have been located for sev eral months past, tho latter, a young man; having boarded with the former, who is a man of family. At 7 o'clock a. n., while young Patty was washing out tho back of the house, Libby took a double-barreled shot gun, heavily loaded with bullets and shot, and remarking to his wife that he was going to kill a rat, slipped ii. lo the back yard, and without a word of warning, placed the muzzle close to young Patty's left side aud emp tied the contents into his body, the charge ranging upwards aud coming out near the right shoulder. The young man staggered a few steps, ex claiming, "What did you do that for?"' and fell forward on his face nud expired. Libby walked into ihe house, and meeting his wife, who, attracted by the shot, was coming out. remarked, "I did not mean to do it," and passing into a bedroom closed Iho door. A moment afterwards another shot was heard, and rushing in the family found Libby lying on the floor, with tho gun lying across his breast, the charge, fired by his own hand, having entered his body on tho right side, and passing directly through his heart, causing instant death. Kb one had ever heard of any un pleasantness between them. The young man reached his majority to day, and was to havo an increased in terest in ihe business. Both men were respected in the commnnitv. Libby, who is over GO years of age, leaves a wife and large family, ami Patty a widowed mother and one sister. The testimony showed that the act was premeditated by Libby, who had been trying to purchase a revolver for several days. It is generally sup posed, however, that the old man was weak-minded, as no cause can be as signed for tho rash act. A jury consisting of H. G. Guild, Adolph Wolfr, J. Wolford, J. G. Smith, W. II. Drake and A. E. Smith re turned .separate verdicts in accord ance with Iho facts, andjho tragedy ended in two acts.
