PUBLIC LANDS AND SPOLIATION.
George W. Julian, who has been
appointed surveyor general of New
Mexico, has an article in the Norlli
Anurican lieview for August. Ho
was instrumental in procuring the
enactment of the homestead law of
1RJ2, which, in his view, is the most
important legislative act since the
formation of the government The
original land policy of this country
was devised for reveuue. The federal
government had a vast public domain.
It was necessary to sell largo tracts
of land after the close or the revolu
tion. The public debt was a very
large one for the time. Sales were
made in very largo tracts to capital
ists. "Tho evils were the price tho
country was compelled to pay to keep
faith with its creditors and provide
the means for carrying on the gov
ernment.'" Laud monopoly had its
inception just after the close of the
revolutionary war. In former times
any occupant of public lands wlio
had not acquired title was considered
to be an intruder. The marshal was
empowered to remove settlers from
tho public lands with the aid of any
required military force.
The right of pre-emption to the
public domain was partially recog
nized bv an act of congress of March
.3, 1S0L affecting settlers on the
Semmes purchase in Ohio. Various
other acts were passed, so that in
1&10 the preemption privileges were
in full force. Tho receipts of the
government from cash sales of land
between tho vears 1830 and 1840 were
nearly SS2,000,000. In 1835 8,000,000
acres of land fell into the hands of
speculators. In 1S11 a general pre
emption act became a law, supersed
ing all previous onactments. The
settler was no longer a trespasser.
Tho old policy of raising revenue
from the salooi public lands had
been so far modified that tho estab
lishment and multiplication of homes
for settlers was the leading feature.
Settlers wero compelled to pay a dol
lar and a quarter an acre, which, ac
cording to Mr. Julian, was a tax of
so much money for the privilege of
cultivating the eailu. It was cer
tainly a nominal price for tho laud.
and the regulations were of immense
beneltt to settlers.
The writer gives a minute account
of all the efforts made to seenro :i
homeitead law. The south steadily
opposed tho measure. The slave
holders called it an "agrarian pro
ject." Andrew Jackson, however,
was a steadfast friend of tho home
stead law. Tho present law was
passed by the Thirty-seventh con
gress, all tho affirmative votes but
one being from the free states, while
all the negative votes but five were
from the south. Tho bill was ap
proved by President Lincoln May 20,
18G2, after a struggle of twenty-one
years.
This brief history of the homestead
law strikingly illustrates the halting
and left handed progress of legisla
tive reforms. The great fiuaucial ex
igency that dictated our early -policy
completely subordinated the settle
ment and tillage of the public do
main to the idea of revenue. This
idea so fastened itscflf upon the gen
eral mind that the problem of onr
land policy wa3 never considered
upon its merits, while tho mischiefs
oE monopoly were allowed free course.
The remarkable result was that the
pre-emption law had to struggle for
its existence more than half a centu
rv. Its final enactment was a great
victory for the settler; but his right
to theunhindered choice of his quar
ter section in any portion of the pub
lic domain that wjis placed upon the
market wa3 not much less important
than the right of pre-emption itself.
The land speculator was licensed by
congress to prey upon the public
domain by appropriating to his
own use great bodies of choice land,
thus throwing himself across the
path of the settler, and forcing him
still farther into the frontier and on
to less desirable lands while obstruct
ing the population and development
of the country. This partnership be
tween the government and the specu
lator in the business of crippling the
settler and retarding the increase of
national wealth, was a3 stupid in fact
as it was iudefensiblo in principle.
It was a crusade against the rights of
coming generations, and had become
a deadly blight upon our western
states and territories wheu the pre
emption law was enacted. As tho
federal treasury was then full to over
flowing, there wus nothing to excuse
its contmuance. it was tue mere
wantonness of legislative profligacy;
and the simplo and obvious remedy
was an enactment that agricultural
lands should be acquired under the
provisions of the pro emption law,
and not otherwise. This would have
cut up speculation by the roots, and
given us a reiorm in onr pplicy tnat
would at onco havo been savingly felt
in every pulso of tho national life.
It w ould havo been an act for the
creat ion of wealth by checking mo
nopoly, stimulating settlement, and
multiplying the cultivators of the
soil. But this was not dons. Con-
I gress slept over its opportunity, and
tne worK or organized piunaer naa
its way. The speculator was in the
day of his glory, while tho govern
ment Btill exacted from tho settler its
price for his pre-emption.
The pre-emption law has been prac
tically superceded at last But whi!o
there has been a substantial gain in
this respect, more than one hundred
million acres have been locked up by
unearned grants to railroads. Con
gress, save in a few instances, has
refused to declare these grants for
feited for non-compliance with con
ditions. Passengers to El Paso over the
Mexican Central railroad from the
citv of Mexico report that yellow
fever is making alarming progress in
Vera Cruze. Already the disease has
materially interfered with travel and
trafiic over the Mexican Central.
The Vera Cruz people, health
authorities and all, charge that
the epidemic was introduced from
New Orleans, while of course the
latter city is confident that yellow fev
er is not indigenous there, but always
brought there from either Vera Cruz,
Havana or Bio Janeiro.
A large force of men. are at work on
tho Cascade division of the Northern
Pacific doing heavy track and tunnel
work. Two tunnels are in course of
construction aggregating 750 feet in
length. The grade is completed t
Green river, and it is expectedthatby
September 1st all but seventeen miles
of grading will be finished, and tho
track laid to tlie western portal or tne
big tunnel at the summit
Prench newspapers continue to
comment upon the recent article in
the North German Qazette attacking
France. They all consider that tho
article foreshows an increase of
Germany's military strength, and
that it was addressed to the Keiohs
tag rather than France.
The state department has received
a dispatch from Mr. Lee, secretary of
the American legation at Vienna,
stating that tho Austrian government
has positively refused to recognize
Minister Keiley.
Colby, tho prospective terminus of
tho Gray's Harbor railroad, is a small
hamlet seventeen miles southwest of
Seattle, on the west shore of Puget
sound. There are about 300 inhabit
ants in the vicinity.
Attempt to Commit Suicide.
Mr. K tried to cut his throat,
and nearly succeeded, leaving a gash
which the" doctors sewed up. He was
led to this act by despondency. Des
pondency came on as tho result of
chronic dyspepsia and debility. This
poor fellow's trouble might have been
spared had he made a timely uso ol
