Commis sioner Sparks, of the general land office, is reported to be working- out the details of a land order, which will, if. promulgated, create a sensa tion among land grant railroad offi cers. It is nothing less than the overflow orjdemnity land system, by the operation of which it is charged that settlers have been largely in jured, and railroads correspondingly benefitted. The nature of previous bureau ru lings, which, tho commissioner pro poses to modify or rescind, can be illustrated in the case of the Atchi son, Topeka and Sante Fo railroad. which last year was compelled, upon appeal of the state of Kansas, to sur render over 8,000,000, acres of land that had been set asido for its indem nity or shortage in the land area granted to that road. It is charged, for instance, that Innils are nujustly withheld from settlement by allowing roads to file maps, and then to seek other and more favorable routes. The land over which later maps nro made may have n large num ber of settlers thereon. ATauv of these are threatened with ousting, on one technicalit or other, and tho road3 claim indemnity for all losses by acceptance of settlement rights. The practice has been to grant indem nity without regard to safe guard or time. It is now proposed to make general iu their application the rules laid down in tho Kausas case referred to. It is understood that the Northern Pacific is especially aimed at in the expected order. This route, in "Wash ington territory, has several time3 been changed and modified, and a large number 'of settlers are inter ested in resisting tho corporation's claim to indemnity.
