AN INTERESTING CASE.
In a matter o tho settlement of
certain road and franchise questions
between B. Hutton andLN. Henness,
of Paciflc county, the decision of,
their separate rights in the premises i
was left to a board of arbitration,
consisting of Justices Griswold, Espy
and Goulter who met last "Wednesday
to try tho case, Mr. Hntton was rep
resented by Joseph A Gill, and Mr.
Henness by G. C. Fulton, both of As
toria. Hutton set forth as his claim
that he with Alfred Baker'and S. W.
Embree, in 1S79 agreed to give Hen
ness the right of way over their land
to build a road from Shoalwater bay
to Hwaco, and to have the exclusive
privilege of hauling oysters and
freight over the road for a term of
five years, and at the expiration of
that time Henness was to turn over
tho business to Hutton. Hutton also
claimed that by, the agreement for
the lease of the road, Henness was to
keep the road in good repair, and get
all freight and oysters through
on time, which he "did not do. as
many complaints had come to Hut
ton of oysters falling to so throuch
on time. The only witness introduced
by Hutton to prove this was L. H.
Bhoades of Bay Center, who testified
of Henness failing to get his oysters
through on time, thereby causing him
a loss of $1,500. 'Henness had abun
dance of evidence to testify that the
agreement of the lease of the road
was to expire during the fall of 18S1,
and at the expiration of that time the
road would be thrown open to the
public to compete for the trade; that
tho road is a good county road; that
oysters and freight had always gone
through a3 quickly as possible; that
only Mr. Bhoades complained. He
also had testimony from oyster ship
pers that ho had always carried
oysters and freight on time, to the
satisfaction of all. Hennes3 also
testified that Hutton had not kept his
agreement as in 1&S3 Hutton put on
a team to haul freight and oysters,
and has been so engaged since. The
case was ably conducted, and at 930
was given tothe court to decide,
which was not concluded aud de
cision rendered until 10 o'clock. The
award wasthat Mr. Hutton was not
obliged to permit auy person to team
over his private road. Intense inter
est was manifested throughout the
trial, parties being in attendance
from all parts of the county. The
award, as it now stands, allows Mr.
Henness to carry on his business as
heretofore, but gives Hutton the
right to refuse him from teaming 6v
er his private road. This does not
affect Henness in the least, as ho can
easily make a new road on his own
land to intersect the county road,
consequently the award appears to
in favor of Henness.

Shively's Astoria, as follews: At its
western end at a bight of 18 leet above
the base of grades. ' At its intersection
with West 9th street at a hight of 19
feet above the base of grades. At its
intersection with West 8th street at a
hight of 19 feet above the base of
grades. At its intersection with West
7lh street at a bight of 19 feet above
the base of grades. At its intersection

above the base of grades. And unless a
remonstrance signed by the owners of
two-thirds of the property fronting on
said portion of said street be filed with
the Auditor and Clerk within ten days
of final publication of this notice.viz Sat
