Judge Deady recently decided in the case of Smith vs. Ewing, that the land department has no right to cancel or set aside a certificate of purchase is sued to aj)ro-emptor for his land for any alleged fraud in obtaining it. Once obtained any one seeking to cancel it rmiBt seek redress in tho courts, and that a purchaser of said lands who is an innocent buyer for a valuable consideration takes tho same purged of any fraud whicb may have been committed in obtaining said certificate." Most of the at tempted cancellations of the certifi cates of pre-emptors having proved up and paid for their lands, on the ground thatthe claims were founded and main tained in fraud, were the result of in vestigation by the "special agents' which the land department has sent out lately to the several land dis tricts to investigate, etc This de cision takes away any effect of their examinations anu renders me gov ernment powerless to set aside the proceedings already bad. The mat ter, if contested, must be so done in a regular judicial manner, on the same terms and conditions as if be tween individuals by a regular suit in court. Meanwhile all innocent pur chasers are protected and their titles cannot be impeached, it being too late. The opinion is a lengthy one and numerous United State Supremo Court decisions are cited in support of Judge Deady's views. It is said that there is one office in the gift of the government that no body wants. It is tho consulship at Monterey. Monterey is a good-sized city, and is a rather pleasant place lo live in. But the people there have j-never gotten over General Taylor's capture of the town, forty years ago. They do not realize that the war is over, and hate Americans as intense ly as ever. Abont two years ago they got mad, smashed in the windows of the American consulate, and assault ed tho vice-consul, a Methodist preacher. To an abie-bodied citizen, who likes excitement and plenty of it Monterey offers an inviting field. Among other forms of animal life whicb have disappeared from the earth is the sea-cow. This great an imal, which has been variously classed with the whales, with the walruses and seals, and with ele phants, was a toothless vegetable feeder, living along the shore in shal low water, and often weighing three or four tons. It was seen alive and described in 1741, but in 1780 it ap peared to have become entirely ex tinct. An Arkansas fourth-class postmas ter is now tho subject of investiga tion. A petition for his removal al leges that he permitted and encour aged coon fighting in the postoffice. If it should appear that he allowed the coon to whip the rooster, assum ing tho coon fighting to have been against male gallinaceous birds, he will be dismissed as an offensive part isan. The number of immigrants who arrived at leading ports last month was 7G.G76. For the eleven months the total arrivals are 2-13,439, as against 45i,20G for tho corresponding period of 1884.
