m hc gattjj gtomu. ASTORIA, OREGON: TUESDAY MAY 12. 18EG SEWSPAPER LIBEL. The law of libel Las received a fresh aud reasonable interpretation in tbe suit of J. Appletou Wilson against tbe Chicago Tribune, where in damages of $100,000 were claimed for tbe pnblicatiou by tbe defendant of a statement that tbe plaintiff had been indicted for murder. A full re traction and apology were made on the following day. It was shown on the trial that tbe Tribune reporter had been deceived by an exhibition of a paper in the office of the state attor ney purporting to be an indictment of the plaintiff, and that the paper bore the signature of the state attor ney, but was uot signed by the fore man of the grand jury. Of course the reporter had no right to see the paper until it was returned into court. Even it the indictment had been found, the publication of it would have been premature and un justifiable, although not unlawful. Express malice being disproved by the retraction, aud there being no evidence to show that the plaintiff had suffered pecuniary injury, the questions for the jury to decide were, how much should be awarded to the plaintiff for injury to his feelings (no other injury having been proved.) aud whether the interests of society in general should be taken into ac count by way of making an example of the defendant Upon these points the court instructed the jury that, in a civil suit for libel, exemplary and vindictive damages cannot be allowed unless express malice is proved, or unless the article was published iu a reckless or unusual or unreasonable manner. The court ruled further, that although the clerks in the state attorney's office may have violated the statute in exhibiting papers to reporters, 3-ct it was no violation of tbe statute for the newspaper to pub lish them, and that, therefore, the jury must not take into consideration the prowling of the reporter in places from which theoretically he ought to be excluded and debarred. Virtually the only question left for the jury was how much injury the plaintiff had suffered personally from a false statement voluntarily retracted on the following day. The jury awarded him $250, carrying costs against the defendant. The plaintiff moved for a new trial, which the judge can hardly grant without running counter to his own instructions. The supreme courts of New York and Massachusetts have settled the matter as to who owns a medical pre scription. The substance of the de cision is that the physician in pre scribing, gives the patient a written order for drugs, and their delivery terminates the operation. The drug gist may, on his own responsibility, renewj.be drugs, for be is a merchant and has a right to sell drugs in any shape. He is not bound to give a copy of the prescription, nor even to keep it, though he usually retains it as a protection in case of error on the part of doctors or patients. Tiie Bay of Havana is said by the geographies to be the finest in the world. It is in the shape of a man's hand the opening into the sea corre sponding to the wrist, and the fingers represented by bays or inlets stretch ing iu all directions. But iu this magnificent haven there is not, and never has been, pier or quay, or dock, or any place for a vessel to land. All the loading or unloading of passen gers, freight or cattle is done by means of small lighters, which are rowed back and forth between the vessel and the land. That was an affecting sight last Saturday when some of the business men of Portland went up by invita tion of Major "Y. A. Jones, to exam ine the government work at the Cas cades. We are glad to learn from the NetcJ that there is not a rational bus iness man in Portland "who is famil iar with the country watered by the Columbia, and the character of the obstructions to its successful naviga tion that is not heartily in favor of the removal of the latter, whatever may be tbe expense incurred." A change of heart is always a cause of joy to those who labored in the heat of the dav. It is considered almost certain that the Central Pacific railroad has ab sorbed tbe O. & C, which means that the road will now be built from Ash land to Delta, and a through railroad line afforded from the Columbia river to San Francisco. Our country, through continental, is a country cemented by the blood of pa triotic millions. The arbitrament of tbe war was the only power that could say whether the constitution was a rope of sand or an article of perpetuity. Now we are hnding out what our country is. I cannot tell you what its possessions are, and you don't know. We can't tell what it will bo fifty years hence. Since the war closed we have added more to tbe wealth of the country, north and south, by utilizing what was cast aside before than what the country was worth. Cotton was king, but the 'growers did not know tbe value of cotton seed nor of cotton oil. Under the guidance and exploration of science we have added more from the refuse of cotton than from the cotton itself since tbe war began. We achieved the freedom of a degraded race, and the Lord ha blessed us. If wo are to go on and enjoy the DieBHinga open o us wo muse rememoer that liberty must be maintained and f reo dom must be our watchword. Freedom has its homo in domestic life and im provement of the people. So long as the American people, and they are doing it south as well as north, strive to establish homo3 and make them happy and pros perous, so long shall the wealth of tbe country increase.
