Jjeall, prouate juugc oi uowmz conmy, nnu made oath to certain statements in relation to the occupancy, improve ments, etc., of the said land, which statements wero in dne course for warded to the land department at Washington, and which statements were alleged to have been willfully false. The defendants, by their coun sel, filed a demurrer to the indict ment on several grounds, amongst which they claimed that a probate judge was .under the haw not a com petent person to administer an oath in such cases; that his certificate as such officer was null and void, and that the crime of perjury could not be committed in taking oath before an officer incompetent to administer the same. After argument by coun sel tho court sustained the demurer on the above-named ground, and the actions were dismissed and the de fendants discharged from prcsecutiot'. This case has attracted a great deal of attention, and Rogers, one of the defendants, had been brought back from the state of New York upon a warrant issued upou the indictment. Hon. J. J3. Allen, U. S. district attor nev, appeared for the United States, and J. F. Capjes and Milton "V. Smith of this city, and Judge Gr.H. Stewart or Vancouver for the defendants. -Oretjonian, 9. An oTH cial proclamation has been issued, stating that the El lUahdi, acting in opposition to the principles of Islam ism, has carried his seditious audac ity to the extent of of issuing further incendiary manifestoes in Hedjis and Yemen against Ottoman authority. Mnsselmen will guard the Soudanese agitator as an impostor and robber chief of the worst kind, and will treat the new appeal to fanaticism and barbarism with the same profound contempt as heretofore. Foirr Smith, Ark., April 8. A pri vate letter from the chief of the Sem inole Indians says Thomas Cloudy, in charge of a squad of Seminole light horse, crossed the Canadian river last week to arrest some Indian fugitives. The' arrested two, but wero resisted by Ilsctor Eogers, a Creek negro desperado. Rogers fought like a tiger, killing Captain Tom Cloudy and mortally wounding Sam Cttdijo before he fell. Rogers was shot all to pieces, and died fighting savagely. Quebec, April 8. Hon. John Cos tingan, minister of internal revenue, in a speech at Levis, defended the policy of the government in the mat ter of the northwest rebellions. Concerning the half-breed claims, he said they were unjust nnd should not be recognized. The Metis had not been wrongly treated by the govern ment, but after settling on the lands they.hau obtained on the lied river, they had demanded others on the Saskatchewan. Salt Lake, April 8. A leading Mormon bishop says that the priest hood has concluded it would be cheaper to buy a statehood for Utah than to endure the annoyances po lygamisls are now being subjected to by enforcement of the laws; that they estimate that $1,000,000 judiciously expended in Washington next winter will effect the object. Among the laity this is now considered to be the plan of the Mormon campaign. ewYork, April 8. The town was profusely decorated with flags and bunting. A number of excursion steamers thronged the bay, decked out with gay colored bunting, and six steamers of the .channel squadron were in wniting, arrayed with flags of all nations and brilliant with various colored streamers. The Osborne was sighted wheu still ten miles out at sea, and when she drew nearer was greeted with salvos of ar-j tillery from the men-of-war. "Wheuj the Osborne touched the pier and the J royal party disembarked, tho throng raised loud and enthusiastic cheers. Dublin presents a lively appearance,! buttheroare many indications that there is no great popular enthusiasm. Outside the route of the procession the decoration of the city is far from being general. Another flag has been substituted for the missing one, and this is now floating over the Mansion house. It Iook Like War. A Battle Reported Fought. . London, April 8. The titundqrd has a telegram from its correspondent in Russia, stating that a battle has been fought on the Murghab river, and that it is reported 500 men were killed. Tho dispatch was sent in cipher, in order to escape the vigilance of ltnssian censors. It is assumed the Russians were defeated. Paris, April 8, The report that peace was concluded with China without the knowledge of tho French ministry is declared to bo untrue. President Grevy, it is said, in the conference with Brisson on Monday, stated the exact position of negotia tions. The ministers decided to se cure a vote of a Tonquin war credit before conclusion of peace. They found that nearly the whole of the amount asked had already been ex pended.
