east side of the Missouri river, and
those portions opened for settlement
are bounUed on the north by Pierre,
and on the south bv Chamberlain.
The area of the district opened for
settlement includes twentv-six town
ships, with thirty six miles to each
township, and WU acres in a mile.
According to the homestead law, ev
ery head of a family, whether an able
bodied man or a servant girl,
and every male over 2G years of
age, lias a right to pre-empt 160 acres
o land. Five minutes after the
time, on Friday afternoon, when pres
ident Arthur signed the executive or
der opening the lands to settlement,
the fact was known in Chamberlain,
and as soon as one man crossed the
reservation line with a load of lum
der thousands of others in waiting
followed him. All the hired girls in
the hotels were in the front ranks.
Not a barber-shop was open. Nearly
all the business men, except the hotel
and saloon keepers, were in the anx
ious and excited crowd. Teams and
wagons were employed to haul set
tlers at S2o per day in advance.
Those who preferred town lots em
ployed a lawyer, who laid out a town
site opposite Chamberlain. During
Friday night the erection of 100
houses was commenced, and the
town is being rapidly built. Masy
of the houses are already occupied by
families. The prospect is that much
litigation aud bloodshed will be the
result of the excitemout. The agent
of the Chicago, Milwaukee aud St.
Paul railroad filed warrants in the
name of his company to a large por
tion of the land contained in the res
ervations and now settled upon. The
Indians are unfriendly to the settlers
and are encouraged by the Indian
agents, who in many instances
drive settlers away. Until a reg
istration office is open oa the reser
vation the settlers will not leave their
claims, fearing that they would be
jumped it they did so. The Indian
agents refuse to register until they
receive formal notice from the gov
ernment that the land has been
thrown open to settlement. In many
cases the settlers were unable to find
the corners of the sections, and when
surveys were made ft was found, in
many cases, that cabins some distance
apart were really on the same section.
Then the question arose who settled
here first, and the man who displayed
the most formidable "Winchester rifle
or navy revolver generally induced
the other fellow to believe that he dii..
The work of erecting shanties on the
claims progresses night and day. Sev
eral law suits have been entered
where more than one have taken pos
session. People from abroad did not
Beem to anticipate the rush, for those
who arrived at Chamberlain Wednes
day found that every inch of the land
had been pre-empted. The trains go
ing to Chamberlain consisted of sev
eral sleepera and passenger coaches,
jammed full of poor fellows who
labored under the delusion that they
had only to visit the reservation and
stay on it over night to acquire pos
session of 160 acres. Agent Gassman
received orders from the-interior de
partment not to allow the Indians to
interfere with the settlers, but there
is bad blood existing and trouble is
feared at any time.

bility of giving up the present man
agement is again being actively dis
cussed by Oregon Railway and Navi
gation stockholders in Boston. Two
suggestions find supporters. One is
that the road be leased to the North
ern Pacific alone; the other that it be
leased to the Northern Pacific and the
Union Pacific jointly. Those active
ly favoring the dual lease by the
Northern and Union Pacific include
niauv of the 0. 11. &N. directors; also
Vm. Endicott, holder of 25.000 shares
of Oregon Railway and Navigation.
President Adam3 is reported favorable
to the arrangement. Smaller Boston
holders of Oregon Railway aud Navi
gation argue that the Union Pacific
should be included iu the arrange
ment, because one Boston property
should help another wherever possi
ble, in order to further the general in
terests of the city.

contracted with the plaintiff as the!

for a lease of its railway was estopped j
to deny its corporate existence or its;
power to make such lease, and also
that defendant had power to take
the lease, and in so doing it was not
acting contray to any law of Oregon
or the public policy of the state.
Judgment was therefore given for
plaintiff against defendant for SGS,
131, rent for six months, together
with legal interest from the loth of
May last and costs and disburse
ments. The Oregoniau Railway company
(limited) yesterday brought a second
action for the rent due in November.

for the same amount will be brought
on the loth of Mav next. A suit in
equity for $50,000- being the 0. 15. &
N. Co's contribution to the Oreco-
uian company's sinking fnnd- will
be brought forthwith. There is also
pending an equity suit, the object of
which is to cause theO.R&N .Co.to
make good its extensive dilapidations 1
on tlie narrow gauge, estimated at
1.0,000 to 5200,000. All of these
snitsaud actions depend upon the

tablished by the decision of the
United St aha court yesterday. There
are besides, we understand, actions
by individual bondholders and share
holders of the Oregoniau Company
(as expressly covenanted in the lease)
against the O. R.N. Sc Co. for their
shares respectively of the rents iu de
fault over and alxive the actions of
the Oregonion Company as a corpora
tion. Tlie Oregonian Company more
over intends to sue the 0. 11. & N. Co.
for damages for operating the railroad
in a manner contrary to the covenants
of the lease, whereby the natural
trafiic of the road has been impeded
and sacrificed and public convenience
hindered. The amount due by the O.
R. fc N. Co. uuder the lease ever wear
is oS,G00 -nearly $200,000 which
will be sued for regularly year by
