The parties must be of the same mind at the same time. A man asks n dealer what the price of an article is; tho dealer answers, giv ing the price; the buyer says ho will tako it Thero is no contract here unless the dealer then agrees to sell it When a man makes au offer and tho other accepts it, tho second must let the first know that lie accepts it If a man agrees to guarantee that an other will pay for what he purchases, those who trust the party on the faith of tho guaranty musi notify tho person who made it, or he will not bo bound. Again, if one offers to pay one hun dred dollars for a horse, the seller to accept in twenty-four hours, the proposer is not bound unless the other does accept within that time. More than thi3, one who makes an offer can withdraw it at tiny time be fore it is accepted. It an offer is made find no time is stated for the buyer to decido wheth er or not to make tho bargain, the buyer must decide within a reasona ble time. The length of timo that is reasonblo differs with tho commodity that is bargained for. Baihvay and mining shares, for example, must bo bought quickly or not at all, for the law will not permit a buyer to wait until the price of goods is sure to have changed, before deciding. With other things that havo a steady val ue a longer timo for reflection is per mitted. The offer must bo accepted as it is made. If a seller offers ten barrels of flour at six dollars & barrel, he is not bound to sell five barrels at that rate. When land is offered for sale and the buyer offers to take it if the title proves to bo good, the buyer has not made a contract that will bind the seller. A contract that is mado in sport, or as a mero matter of form, is not binding. If a mau makes a promissory note while showing another how well he can write, the note is not binding upon him unless it has been sold to some person who knew nothing about it and paid for it A man who is embarrassed in bnsi ness gives a bill of salo of his prop erty to a friend, to cheat his credit ors. No contract exists and the creditors can hold tho property. But tho person in whose favor the bill of is mado out can hold the goods against the fraudulent debtor. Another case of this kind is often seen in newspaper articles. We read that a lady and gentleman go through tho marriage ceremony at a public entertainment to amuse their friends, and afterwards find that they arp roally married. This is not true. Tho marriage contract is no more( binding thnn any other contract nn-j less it is made and intended seriously, not in sport. The contract must be mado freely and not undor compulsion. If a rob ber holds a pistol at a traveler s head and threatens to shoot him unless he gives a note for a sum of money, the note thus obtained is worthless. Again, a landlord takes a boarder's wedding suit from him on tho day tho latter is to be married, and re fuses to give it up until a note" is given for board due. The landlord cannot enforce the payment of a note so given. False statements made by either party will make a contract worthless. If a person buys land, the seller say ing that there are twenty-five acres in the plot, tho buyer may refuse to accept it if there aro in fact only twenty-three acres. GEN. Ho is no pauper nor in ab solute penury, except by comparison with his former prosperous estate. Ho is now on his feet again for anoth er chance after wealth. His course lies to Mexico, where ho is to survey, acquiro and share in owning an im mense tract of land. "I have high hopes of dying a millionaire, after all," ho said to me, before setting out, "but I may fail, and I am con vinced that this is positively my last chance. I haven't any time to lose, and I feel like a gambler who has wagered his final remnant of money. My capital was energy, boldness and possibly some brains, and. I have got to tho end of it, after playing a pretty heavy game of alternate winnings and. losses. This is the last throw of tho dice."
