.-1 CONSTITUTIONAL CONVENTION.
Hon. C. Leinexwxbee, representa
tive from Clateop and Tillamook, lias
introduced a bill providing for a con
stitutional convention to meet in Sa
lem next October. It would appear
as though the time had about arrived
when a change in the organic law of
this state was needed. It is not ab
solutely necessary even now. A man
can live and prosper in Oregon under
the present conditions, but existing
conditions are radically different
from what they were in 1859.
On this subject yesterday's Stand
ard has something to say from which
we quote at length:
Among the recommendations for
necessary reforms in the state govern
ment, embodied in Governor Moody's
first biennial message, is one for the
holding of a convention to revise the
constitution of the slate. One great
objection to the old organic law of
the state is that it is more of a code
than a constitution, and embraces
many points that should never be
placed in the fundamental law of any
state in the Union, for the reason
that they prevent necessary legisla
tion from time to time except by the
amendment or revision of tbe consti
tution. There are some features of
tho old organic law that it would be
well enough to re-enact, however, es
pecially those sections relating to the
creation of debts by the stato or tho
sevoral counties thereof.
Another objection to the old law is
tho salaries of the state officials. The
governor now gets 81,500, which is
less than half the salary of any bank
accountant in this city; the secretary
of slate gets 61,500, which would not
pay the wages of a "blacksmith" fore
man iu a patent-outsido country news
paper office; and the state treasurer,
who has uuder his charge often a half
million at a lime, gels less than any
illiterate dock watchman who keeps
the rats away from 500 sacks of flour.
Hut the two last named officers get
fees which go into their own pockets
instead of into the stale treasury,
which is nil wrong from the ground
up. The state officials should be com
pelled to pay into the treasury, under
oalh, quarterly, all fees received by
them iu discharge of their duties; and
they should receive such salaries as
will enable them to live iu ease and
comfort, not to say in luxury and os
tentatious display. The fee system
is merely a legalized robbery, for in
most cases while it doc3 not rob the
state, it robs the people composing
the stale.
As the mailer now stands no man
but a rich one can afford to be elect
ed govomor of Oregon. Moody had
been a successful merchant at The
Dalles and could afford to pay for
the empty honor, as he is reported to
have spent over $20,000 in Salem
during the past two years. But the
salaries of public officials should be
fixed at such rales as will afford ev
ery official a comfortable living and
bar no honest mau from accepting a
public trust by reason of a scanty
purse. And whilo we believe that
the gentleman of Wasco has made a
good governor, as governors go, yet
we also believe there are a dozen
men in either of the two great politi
cal parties in this state, better quali
fied for the position than himself,
who daro not accept a nomination
for such a place on account of insuf
ficiency of private fortune. A public
I rust should be open to any man who
comes under tho Joffersonirn lest of
"Is ho honest and is he canablo?"
And the question of "Is ho rich
enough to do the honors of the of
fice V should never be allowed to
enter into consideration.
California pays its governor $0,000
a year, which is as excessive as the
pay of Oregon's governor is deficient.
Make the salaries of governor and
secretary of stale each $3,000; the
treasurer and superintendent of pub
lic instruction each $2,400; the at
. torney general and superintendent of
the penitentiary each $2,400; and
create the office of surveyor general
at $2,400 by abolishing the present
land commissioners' board. Make all
these officials pay into tho slate treas
ury, uuder oath, all fees received by
them for discharge of their official
dnties; and the fees of the secretary
and treasury alone will come pretty
near paying tho whole bill. The way
that tho friends of candidates for
these offices -spend money about the
conventions of both parties, while
nominations for govemor and con
gressman go a-begging, shows there
must bo something more in the fees
of those offices than the f ramers of
our constitution intended that there
ever should be.
Hence, for tho reasons set
forth above, the proposition to
amend the constitution of Ore
gon may not be deemed prema
ture. California went thirty years
without amending her constitution,
whilo Oregon's is but twenty six years
old. Nevertheless, it was the en
croachments of corporations upon
the rights of individuals which pre
cipitated the formation of a new or
ganiolawforour sister state; and
the same causes which lead that step
in California are now here at our own
doors. When our constitution was
framed we had no railroads within
tho state; now we have about 1,000
miles in all, some operated
under foreign charters, whilo others
are incorporated here. To equalize
rates of transportation over these
lines, a question involving the rights
of tho primary producing class in
a pre-eminently producing state,
should be within tho pale of
a board created by constitutional
provisions, whose members should
be punishabla by. impeachment when
ever found corrupt or negligent iu
discharge of their offioial duties. It
is for reasons like these that a new
constitution is needed. Had there
been no railroads built within the
stale, we might have gone on twenty
years longer with the old constitu
tion; but seeing that the transporta
tion systems of our state are now
owned wholly in Germany or the
Atlantic states, and that their sur
plus earnings are all spent abroad,
we come to the conclusion that the
proposed revision of our constitution
is not a premature movement.
