Ordinance No. 704.
An ordinance concerning disorderly
conduct
The city of Astoiia does ordain as
follews:
Sec L If any person or persons
shall cany any basket or baskets, buck
et or buckets, bag or bags or any other
thing suspended from or attached to
poles across or upon the shoulders, or
shall carry any rubbish, garbage, swill
or filth so as to be offensive to pedestri
ans, upon any sidewalk they shall be
deemed guilty of a misdemeanor and
upon the conviction thereof bcorc the
police court, shall be punished by a fine
of not less than five dollars or more
than one hundred dollars, or by im
prisonment of not lejs than one or
more than twenty days, in the city jail.
Sec 2. If any person shall remove,
transfer, or transport through any of
the public streets of the city of Astoria
any swill or garbage, except it be in a
tightly covered box or apparatus, or in
such a manner as will prevent the con-

the public street, or from being exposed

transportation shall be guilty of a mis
demeanor and upon conviction thereof
shall be fined not less than five nor
more than one hundred dollars er by

Sec 3. if any person or persons shall
cut, saw, or split any wood on the side
walk of any improved street within the
city, shall upon conviction thereof be
fined not less than two or more than one
hundred dollars, or bv imiirisnnninnt. in
the city jail until such fine and costs of

days.
Sec 4. Any nerson who shall nncr
stick, stamp, paint or otherwise affix or
cause to oe done by another auy notice,
placard, bill, poster or advertisement to

or curbstone, lamppost, hydrant, shade

Sec 5. In case of conviction of any
of the offenses mentioned in this ordi
nance, the court shall adjudge the offen
der to pay the costs of prosecution, and
shall in default of payment of fine and
costs, commit the offender to the city
jail for a term of imprisonment not ex
ceeding twenty days, and in all cases
where the term of punishment in the
city jail in lieu of a fine shall not be fix
ed by the Police Judge the offender
shall bo imprisoned fn default of pav
ment of fine one day for each two dol
lars of such fine: provided that in no
case the term or imprisonment shall
exceed a period of twenty days.
Sec 6. It shall bo the duty of the
Chief of Police and the police force to
see that the provisions of this ordinance
are enforced.

Common Council of the City of Astoria
propose to establish the grade of that
portion of Seventh street in the City of
Astoria as laid out and recorded by
John McClureand extended by Cyrus
Olney, as follews: At its intersection
with Cass street, 100 feet; at its inter
section with Genevieve street, 83 feet;
at its intersection with Olney street,
SO leet; at its eastern end 89 leet above
the base oi grades.
And unless a remonstrance signed by

STOXE LANDS.
It may not be generally understood
that the act of congress of 1878, for
the sale of timber lands in tho state
of California, Nevada, Oregon and
Washington territory, applied as well
to stone. This is, any one may take
up 160 acres of land, valuable chiefly
for stone, on the same terms as tim
ber lands, at a minimum price of $2.50
per acre. It does not apply to lands
containing gold, silver copper, quick
silver, coal, etc, and refers to land
unfit for cultivation and chiefly valu
able for timber and stone.
"When any one applies to purchase
a tract for the stone contained on it,
under the act referred to, he must
make affidavit of citizenship or inten
tion of becoming such. IJe must
also make a sworn statement setting
forth that the land is uninhabited, is
unfit for cultivation, is chiefly valu
able for timber or coal, contains no
mining improvements, or deposits of
gold, copper, silver, coal, etc.; that it
is not bought for speculation, but in
good faith for use, and that ho has
made no agreement to dispose of it to
others.
Then he must publish the required
notice, and have an affidavit of the
publisher of the paper in which the
notice was published. Two disinter
ested witnesses must swear to the
non-mineral character of the land.
This testimony must all be taken be
fore the register and receiver, and if
no adverse claim is filed, tho appli
cant will be allowed the entry and get
his receipt for the purchase money.
The register or receiver is entitled to
a fee of So, and 22K cents per hun
dred words for testimony reduced by
them in writing for the claimants.
In case of an association of persons
making application for such an en
try, each of the persons must prove
requisite qualifications, and each
name must appear. They must also
unite in the regular application for
entry, which will be made in their
joint names, as in other cases of joint
cash entry.

Ordinance No. 703.
An ordinance regulating the man
agement of fires and tho protection of
property.
The city of Astoria does ordain as
follews:
Sec. 1. The Common Council of the
city of Astoria shall at its first meeting
in October of each year appoint from
each company of the fire department of
the city of Astoria four active members
to be recommended by the Chief Engi
neer of the fire department to act as
fire police at and during all fires.
Sec. 2. That the fire police so appoint
ed shall, at all fires, under direction of
the Chief of Police, to place ropes or
guards across all streets on which shall
be situated any building on fire and at
such other points as may bo deemed ex
pedient and necessary by the Chief En
gineer of the fire department and they
shall prevent any and all persons ex
cept members oftiie department wno
shall be known by their badges or by
identification by the firemen of his com
pany, insurance agent?, members of the
press, and owners and occupants of
buildings endangered by existing lire,
from entering within the line or guards
so placed, and any person or persons
enterins within said lines orcuards and
retusing to go outside ot said lines
when ordered to do so by any fire po
liceman or officer of the fire department
or police officer shall be liable to a fine
or imprisonment or both as provided
for in this ordinance.
Sec. .'".No person or persons shall
break through or attempt to break
through such blockade or run over any
line of hose at a fire.
Sec. 4. All steam engines and other
movable apparatus of tho fire depart
ment shallliave the paramount right of
way through all streets and thorough
fares of the city of Astoria when going
to a fire and such apparatus, together
with all other vehicles contiguous there
to, excepting street cars, shall take and
keep the right side of the street, unless
the same be obstructed, and all street
cars in the vicinity of such apparatus
going to a fire shall retard or accelerate
their speed as occasion may require, in
order to give the apparatus of the fire
department the unobstructed use of the
street for the time being.
Sec. 5. No person or persons having
the control of any vehicle shall wilfully
or carelessly permit the same to ob
struct the progress of the apparatus of
the fire department while going to a
fire.
Sec. 6. Any person who shall violate
auy of the foregoing provisions of this
ordinance shall be deemed guilty of a
misdemeanor, and on conviction there
of before the police judge be fined not
less than five dollars nor more than one
hundred dollars or by imprisonment in
the city jail not more than 20 days, or
by both, as the police judge may deter
mine. Sec. 7. The Chief Engineer of the
fire department, assistant engineers,
clerk of the department, and Chief of
police and police officers and fire police,
are directed to see that the provisions
of this ordinance are enforced, and
make complaint in the police court for
the violation of the provisions thereof.
