The passing of tho ordinance last night granting tho right of way to a street rail way is a long step forward in the prog ress of the city's growth. It is said by those who build the road that street cars will be running by the 1st of next No vember. Clark Loughrey received a telegram from Chief Crowley, of San Francisco, last evening, saying that the description of one Marsala, which ho telegraphed from here, answered the appearauce of a man arrested thereon suspicion of be ing Marsala, who is accused of having shot Mattin at Sand island last June. Baldatta was convicted of having cut Matlin, and the charge against Marsalla is that it was he who did the shooting part of the attack. He will bo sent for and brought up here as soon as possible. Talking with several of the firemen yesterday about the fire last Monday night, the suggestion was made that when the rope was stretched, inside of whioh no one not a fireman, was to be admitted, that a cordon of firemen be do tailed whose business it would bo to stand by and see that the enclosure be kept clear. Nothing so impedes haste or so interferes with a man rushing around the best ho knows how, trying to help, as to be bumping up against a crowd of people who are looking eagerly at tho fire ana don't always see just where they aro going. The Kinney caso, which has so long occupied the attention of tho circuit court, now goes to Judge Smith for ad judication. The case began in '81, in re lation to sundry transactions in salmon. The principal points in tho suit, briefly stated are about as follews: The estate of M. J. Kinney sues E. D. Heatly, et al., claiming that in settlement of accounts there is a matter of 18,000 interest wrongfully charged; a claim of $13,0C3 as commissions on purchases and sales for account of the cannery, in addition to the salaries of the trustees, is also a point of dispute, and another matter in reference to about 20,CC0 concerning alleged reclamations, constitutes another point of legal difference. The following communication was read: "To the Honorable Mayor and Mem bers of tho Council Gentlemen: I here by tender my resignation as a member of 3our bouy. I. W. Case. On motion the resignation was nc cepted and council adjourned. THE O. I). O. PICNIC. O.D. O.? What is that? Well, never mind. When we tell you, you will know as much as wo do. At about eight o'clock this morning a merry party assembled upon the deck of the Gen. Miles. Basket after basket of choice luncheon came on board, and tho' the skies were lowering, the spirits of the ladies and gentlemen were buoyant. Arriving at Ilwaco at ten o'clock, wagons wero found in wait ing, and as the slight mist still contin ued, a .council was called. Mr. A. W Berry, Henry Thompson, Mr.Tallant and some others of the club decided that Mrs. Holman, who has two nice cottages at Ilwaco, was entitled to tho honor of a visit, and at once steps were taken thitherward. A most cordial reception awaited the guests, and that good feeling and ease which accompany good breeding, reigned supreme. To those who know the many good things offered by nature, as sisted by skill, in taking ad vantages of her bounties, it is unneces sary to recount tho advantages, of which full use was made. Leafy umbrageous paths lead to sheltered nooks where quiet comfort and the bracing sea air may be enjoyed. Those who delight in tho roar of old ocean may indulge their liking by a walk of about a mile, over a fine plank road, and gaze upon the kalcidosopic changes which the eternal sea is ever printing. Poetic fancies perhaps en dure for a brief time, and they aro doubtless an incentive to enjoyment of luncheon. But how shall wo 'describe that luncheon, prepared with knowledge and skill by Astoria's fairest daughters? Some of tho club members were disposed to indulge in a second dinner, and if one of tho party did pass his cup six time3 it was only an evidence that tho coffee was excellent. Did it rain? Well now that is a leading question and tho court takes the papers and reservesjits decision. If it rained it did not harm the O. D. O. club. The members returned jubilant, and the happiness refleoted upon the faces of tho ladies was fully shared by the gentlemen, who declared that it w;is a dutj' and a pleasure to "do it again."' The party returned at C i. m., and we shall be much surprised if we do not have the pleasure of noticing many recur rances of this comfortable and happy custom, for which Astoria is famous. A vote of thanks was presented tho ladies for their careful preparations, and when the members of the club separated at the dock a .memorable event even in the history of Astoria picnics came to a happy termination. The good will connected with the estab lishment of any particular trade or oc cupation may be the subject of barter or sale. It is a valuable right, and if it be unlawfully destroyed or taken away tho law will award compensa tion to tho injured party. It is defined to bB "the advantage or benefit which is acquired by an establishment, beyond the mere vjilueof the capital stock, funds or property employed therein, in conse quence of the general public patronage and encouragement which it receives from constant or habitual customers on account of its local position or uncom mon ability, or reputation for skill, afflu ence or punctuality, or from other acci dental circumstances, or necessities, or oven from ancient partialities or preju dices." It is claimed here that the plain tiff is seeking to recover for his loss of profits in trade, and for tho injury to his good will. But the attachment com plained of drove his customers away and ho lost their, trade. Now it is plain that if, bjT any means, customers aro driven away from a particular locality to which they resort to trade, that trade loses that which wo have described as good will. The distinction between profits and good will is obvious; profits aro gains realized from trade; goodwill is that which brings trade. A favorable location of a mercan tile establishment, or habit of customers to resort to a particular place, will bring trade. This advantage may bo designated by the term "good will," and what tho trader gained by the trade so acquired aro profits. Carey vs. Gunnison, Supreme Court of Ioica. OCR MOTTO. "Get tho best." This is tho way: Ingredients Twenty-five clams, four ounces of salt pork, four medium-sized potatoes, two onions, six sliced tomatoes and two pilot biscuit. 1111 the clams over the fire in their own liquor; boil two or three minute, strain and return the liquor to the fire. Fry in butter the size of an egg tho onions, cut small, and tho pork also cut in little dice; when this colors stir in two table- spoonfuls of flour, and when cooked add the clam liquor, the tomatoes, the po tatoes cut in dice, the least bit each of mace and thyme and pepper to taste. Cook slowly until the potatoes are done; add the clams cut in pieces, the crackers broken small, and one cupful each of hot slock and croara or milk. Taste to seo if it is seasoned properly. Get if possible the razor clams. "How about clam stew?' inquired the reporter. "Set tho liquor from twenty-five clams ou tho fire in a porcelain stew-pan; boil for two minutes, skimming carefully; and then add u pint of hot water and the clams cut in pieces; simmer for fifteen minutes; thicken with rolled cracker; season with pepper, salt and n lump of butter. Boil up once and serve in shal low soup-plates. "For clam soup," continued the cook, "put a quart of clams on tho fire with their liquor and a-pint of water. As soon as they hnve boiled and been thoroughly skimmed take out the clams with a colan der dipper; chop them and return them to the liquor with a tiny pieco of onion and a littlo parsley and mace, if liked. Simmer for fifteen minutes. In the mean time make a roux with butter, size of an egg. and two even tablespoonfuls of Hour; stir in slowly a pint of hot milk. Add this to the clams and servo at onco with out boiling. Season to taste. "A very delicious soup, that may really bo called a bisque, is made as above, ex cept that the clams and onions are strain ed out and only the liquor added to the roux, which should have a half pint each of hot stock and cream stirred in instead of tho pint of hot milk. Red peppor is best in tho seasoning." "I suppose that about completes the list, does it not?" intimated the reporter. "By no means," ho responded. "There's clams with cream. This makes a very nice soup course or a tasteful breakfast or lunch dish. Pot into a slew-pan but ter the size of an egg and when it bub bles stir in ono tablespoonful of flour; stir gradually into this the juice from twenty-five- clams and then the clams cut in pieces and seasoned with pepper; stew for five minutes and add a cup of hot cream. Have several small. pieces of toast an inch square in each soup plate. "Clams and their liquor burn very readily, and great care must be taken to prevent this by stirring. "And then there's clam fritters," he added. "Chop fifteen medium sized clams with a ten-cent bunch of soft shell clams. Add half a cup of tho liq uor and as much of the milk; stir in two beaten eggs and fiour enough to make a batter, as for fritters. Sift an even tea spoonful of sea-foam through tho fiour. Drop in small tablespoonfuls into boiling hot fat.'. "Perhaps a clam pie wouldn't be a bad idea." "In many summering places," said tho culinary lord, "particularly if you board with a native, you will eat a delicious clam pie mado by your landlady, who never heard of pnff-pasto or a pate. A tin or crockery pie-dish is lined with paste, filled nearly full of chopped clams, seasoned, and enough clam juice and milk to nearly cover the clams. The whole is then covered with a crust, neatly pinched short around the edge, pricked with a fork; .and baked until the crust ts done. The clams are fresh, your appe tito is good and your hostess" is pleased when you pass your plato a second time." Mr. Philip Beichart, Postmaster, New Baden, Robertson Co., Texas, writes that jtfr. Spontaneous combustion has its re sponsibilities in this country, as the in surance companies realize. Statistics show that thero were in the United States last year 203 fires of consequence attri buted to spontaneous combustion, de stroying property valued at $3,115,168, npon which there was insurance to the amount of 1,864,202. In the statistics referred to every fire is mentioned, and it is found that they occur in barns, gran aries and stables, carriage and wagon fac tories and wheelwright shops, drug and chemical stores, dwellings and tene ments, furniture and upholstery factories, junk stores, printing and publishing es tablishments and vessels at wharves. There are more of this kind of fires in summer than in winter, showing that at mospheric heat helps along the chemical action to which spontaneous combustion is due. The next question is as to how many of these cases of spontaneous com bustion are due to carelf s ness. The man who throws a mas3 of oily rags down into a corner and leaves them, or a lot of saw dust soaked with oil or acids is pretty sure to havo a case of spontaneous com bustion, and so far at his moral relations to tho insnrance companies aro concerned he might as well tos a lighted match into a pile of shavings, aud destroy tho in barns, granaries and ship holds results from storm? grain, liav or straw, and fibrous freight when in a damp or other- ise improper conoinon.
