pany's office has been removed to room
No. 5, Pythian building, in the office for
merly occupied by Judge Taylor.
EL Staff and Anton Tusin were arrested
yesterday on a charge of stealing net
from Aug. Norburg, and will bo given a
hearing before Justice A. T. Brakkc to
day. This rainy weather is getting to be a
trifle monotonous. Now that the salmon
season is closing wo want to cat our hay
and oats and get our wood in and do
Rome road repairing and fix up gen
erally. It was stated on the street yesterdaj'
that the circus would pitch its tent at
Alderbrook for the performance,aud that
the steamers would pty between here and
that point for the benefit of all who at
tended.
Marwell Young, who has a thrifty gar
den at Alderbrook, has some of the finest
vegetables and fruit that came to hand
this season. His peas, espacially, are the
largest and finest that have been brought
to our notice.
The county court was in session yes
terday auditing bills and adjusting
claims. It was decided to have the court
house cleaned and fixed up. The mat
ter of building a new court house was ta
ken under advisement.
Frank Fabro opens this morning at
his new restaurant and chop house. He
advertiso3 coffee, ice cream, oysters etc.,
in first class style. His place is on Cass
street, rear of Odd Fellows' building,
three doors above his former stand.
The Astobiav is in receipt of a com
munication from Frank E. Hodgkin, sec
retary of the Firemen's Association of
Oregon in reforenco to the coming tour
nament at Albany. Astoria will send two
teams in friendly competition for the
prizes offered.
Captain Scott, of the Meetwood, who
took the Northern Pacific's transfer boat,
the Kalama, on her recent trial trip, says
that she steers as easily as his own boat.
"When accepted, which will probably be
on the 1st prox., she will be commanded
by Captain Gove.
There is said to be a gang of light
fingered gentry following the circus, so
that our citizens would do well to lock
their doors to day before going to the
show. The management are on the
square, but from all accounts there are
some pretty tough chaps in the outfit.
Hadj Mahamnied, the giant Arab who
supports the huge pyramid of eleven men
in Cole's circus, has heard of the prowess
of Sullivan the slugger, and the desert
born athlete says that ho will agree to
knock the famous pugilist into the arms
of Abraham, or else he will sacrifice his
own head to Allah the Great.
Parties who have given the matter
considerable study are of the opinion
that should active operations begin at
the month of the river looking to per
manent improvement, it would be more
effectual to drive a double row of piles,
with mattresses between, than to attempt
any costly stone work that wonld prove
impracticable.
"W. "W. Cole is the richest man in the
show business. He is the sole owner of
his great exhibition, and his real estates
in Chicago and other cities are a source
of large revenues. Ho is only 3i years
old, and has already made one trip
around the world with his mammoth en
terprise. His profits last season amounted
to something over halt a million.

The .mx chairs wherein do sit the half
dozen councilmen were filled last even
ing with the exception of that of Coun
cilman Case, when Auditor Jcwett called
the roll, and the six gas jets overhead
gleamed brightly, as Mayor Hume an
nounced the regular order of business.
The first thing that was tackled was a
petition from Mrs. O'Brien for a saloon
license for one j'ear, which was granted.
Councilman Cleveland moved that the
petition of Washington street property
owners be granted: he thought it was
about time something was done in the
matter. The petition in question was
produced and read, after which Council
man Cleveland's motion wns seconded
and carried.
A remonstrance was then read from
Arch stieet residents, remonstrating
against the proposed improvement of
that street, which had the effect of post
ponlng said improvement until the in
definite future, Councilman Dealy mov
ing that the remonstrance be granted.
The report of the committee to whom
was referred the matter of improving
Jefferson, Cedar, Cushing's Court and
Farrell streets, recommending its amend
ment, was accepted.
The committee on health and police
finding correct the report of the polic6
judge for June, was adopted. The same
thing was done in the cases of the street
superintendent and city sexton.
The next thing was the consideration
of

An ordinance refunding to the estate of
M. J. Kinney ?CG surplus assessment,
was read first and second times and
passed under suspension of the rules.
An ordinance providing for the time
and manner of improving Squemoqua
street from the west side of Cass street
to the west side of "Washington street,
was read first and (second times and
passed under suspension of the rules.
An ordinance providing for the time
and manner of improving Main street
was passed under suspension of the rules.
An ordinance making an appropria
tion of 132.10 to pay claim of city treas
urer, was passed under suspension of
the rules.
An ordinance granting a license to
Mrs. O'Brien, was passed under suspen
sion of the rules.
An ordinance to provide for tho pre
vention of fire was not carried, it being
considered unjust by the committee to
whom it was referred.
An ordinance repealing an ordinance
requiring restaurants, barrooms etc., to
closo betweon midnight and five a. m.,
was read third time and lest: councilmen
Cooper, Cleveland and Stone voted for
its passage: councilmen Dealy and
Trenchard voted against its passage.
An ordinance providing for the time
and manner of improving Olney street,
was read third time and passed.
An ordinance providing for the time
and manner of improving Cushing's
Court street, was read third time, and re
ferred back to committee on motion of
Councilman Dealy.
An ordinance declaring the time and
manner of improving Farrell street mot
tho same fate, with objections noted
thereon.
An ordinance declaring time and man
ner of improving Cedar street was read
third time and referred.
Councilman Trenchard then moved
that tho rest of the batch be referred,
which was carried.
Councilman Trenchard then called for
the ordinance in relation to raising the
salary of the police judge. The ordi
nance in question was then read the sec
ond and third times and passed. The
ordinance in question places tho salary
of the police judge at $7i per month.
CLAIMS.
The following olaiins were then ordered
paid bv warrant on tho treasury: Carna

Light Co., $113.33: J. H. D. Gray, $4.75;
C. E. Jackins, $10.75; Astor House, $19:

A resolution introduced by Councilman
Cleveland in regard to removing all ob
structions and offensive material on the
beach, was debated, and Councilman
Trenchard suggested that any one found
dumping such offensive material in the
city limits be prosecuted. Mayor Hume
said that the beach was in n fearful
state: Chief of Police Loughrey said
there was a force of men employed and
that tho dead salmon drifted in very fast.
Councilman Cleveland thought that thero
was not enough, and that it was good
economy to put on enough to make a
good job of it. Councilman Dealy sec
onded Councilman Cleveland's resolu
tion. Tho resolution was unanimously
passed.
A communication w;is read from C. F.
McCormac resigning the position of city
attorney. The resignation was accepted.
Councilman Dealy nominated F.D. Win
ton to fill the vacancy. The nomination
was not confirmed. l Councilman Stone
nominated Geo. Noland, who was unani
mously confirmed.
Mayor Hume instructed the Chief of
Police to notify all cannerymen within
the city limits that there must bo no
more salmon thrown on tho beach. On
motion of Councilman Stone tho council
adjourned.
The shattered booms have disappeared,

For now the heelers are perplexed;
They cavil at each campaign carol.
And mutter in a manner vexed,

COXXEBCIAL LAWS; RECENT DECISION.
PAETXEEsnrr Libel. One of a firm of
dealers in furniture and draperies put
upon a piece of furniture placed on the
pavement, "Taken back from A. B. who
could not pay for it; to be sold at a bar
gain." In a suit for libel upon this act,
two questions were decided against the
defendants, the firm: 1. That tho court
could determine whether or not the pla
card was a libel. 2. That every member
of tho firm is liable, though one only put
up the libellous matter, and without the
knowledge, direction or consent of tho
others. In this case, "Woodlin vs. Knick
erbocker, the supreme court of Minneso
ta, on appeal, reversed the court below.
The Chief Justice, Gilfilian, in the opin
ion baid: 1. "What meaning, whether
injurious, or not injurious to the plain
tiff, these words would convey to ordinary
men who read them without a knowledge
of tho transaction to which they referred,
was for the jury to determine, in iew of
the circumstances, under which they are
exposed to tha public perusal, and
whether they ara libellous or not. ought
to have been left to the jury to say. -'.
A person cannot be held liable for a libel
published by another unless he has au
thorized him to make tho publication.
There is nothing in the nature of the
business of this firm that of dealing in
furniture and draperies from which au
thority to one partner, or to a servant, to
gratuitously publish a libel can be ap
plied. The case is different from that of
a partnership whose business is publish
ing or selling either books or newspapers,
where each partner is supposed to have
authority to publish or sell, and to de
termine what shall bo published or sold,
and also from that of the necessary cor
respondence of the firm, where each part
ner is presumed to be authorized to con
duct it and to delermino on his substance
and terms.
Sale Piace or Dklitcey. Hardware
merchants at Minneapolis agreed to sell
and deliver to a resident in another town
in tho state a quantity of glass. The
merchandise was not on band, but had
to be bought in St. Louis. The evidence
as to the place of deliver was conflict
ing; that of the vendors, that the glass
was to be put on the cars at Minneapolis,
and that of the purchaser, that it was to
bo delivered to him at his town. In the
trial of the action brought by the merch
ant to recover the price of the goods, tho
court charged the jury: "Tho burden of
proof was upon tho 'defendant to show
that the glass was to bo delivered to him
at the place of his residence." The de
fendant carried tho judgment, which was
rendered against him in the case, to tho
supreme court, where an affirmance was
had. Judge Mitchell, in the opinion,
said: "There was no error in the charge.
If no place bo designated by tho con
tract, tho general rule is that the articles
sold are to be delivered where they are
at tho time of sale. This is a rule of
construction predicated upon the pre
sumed understanding of the parties when
making tho contract. This rulo is not
changed by the fact that the vendor does
not have the goods at the place of sale at
tho time the bargain is made, but must
procure for delivery. Potentially and
prospectively the goods were as if then
placed in the store of the vendor." Jen

L. and D. were partners. D. failed to
furnish his portion of tho capital, and to
adjust tho matter agreed to take out a
policy of insurance for the benefit of L.
Tho policy was issued and delivered to
D., who retained it until the dissolution
of the partnership, when he handed it to
L. "to show that he intended to do what
was right." D. paid the first two pre
miums and L. the rest. Tho application
was signed by L. & D., and the policy, in
consideration of a sum paid by L., in
sured the life of D., and promised to pay
the "said insured," etc. It was declared
to be accepted by tho "assured" upon tho
condition that the persons "whoso life is
hereby insured," etc. Hold, that there is
no distinction necessarily involved by tho
terms "insured" and "assured." The
parties to whom they refer must general
ly depend on the collocation and context.
Here the term "assured" referred to the
party for whoso benefit tho policy was
procured. The insurable interest of L.
was sufficient to support the policy. The
transaction having been made In good
faith, statements of D. as to the amount
of his interest in the life of L., though
they might appear as excessive, will not
be a breach of warranty where, as in this
case, no definite value could be assigned
to such partnership interest. Conn.

he directed that a certain bond bo given
him for the property assigned, but not
payable for three years, should first bo
paid, and there was provision as to the
disposition of the storo, fixtures and
goods. In fact the assignor continued
in possession of tho store, and sold and
supplied tho stock. A creditor filed a
bill to set the assignment asido on tho
ground that a full and complete delivery
of tho assigned estate had not been
made. In this case M'Cormick against
Atkinson, the plaintiff succeeded, and
tho defendant took tho decree to the Su
preme Court of Appeals of Vireinia.
where it was affirmed. Lewis, the pre
siding judgo in delivering the opinion,
said: The deed for creditors is void, bo
cause tho assignor has retained substan
tial control of the property assigned,
for a deed of conveyance professedly to
secure creditors, in which the grantor ex
pressly or implicitly retains a power in
consistent with and adequate to the
defeat of the avowed object of the deed,
is void against purchasers or creditors.

before the maturity of the note it was as
signed to tho plaintiff, who foreclosed the
mortgage and sold the property, when it
was found that tho property was incum
bered by a prior mortgage, so that the
plaintiff did not realize the amount of his
debt and brought suit against A to re
cover. In deciding this case, Dundee
Mortgage and Trust Investment Company
vs. Hughes, the United States Circuit
Court, District of Oregon, held there was
no priority of contract between A nnd
plaintiff, and that he was not liable to the
latter for the loss.

THE COMING STATE FAIR.
A copy of the annual catalogue of the
Oregon State Agricultural Society has
been received. As has been stated in this
paper before the state fair will bo held
from the 15th to the 20th of September,
inclusive, next. "We observe several
changes have been made by the society
for the fair of this year which cannot
but be appreciated b tho public and add
to the interest of the fair. Premiums
have been proportionately equalized and
soveral new ones added. Notably the
roadster and graded draft horses have
been reinstated to a place in the premium
list: several new premiums have been
made in the ladies departments, and a
committee of zealous ladies has been ap
pointed to co operate with the society
in the interest of making this department J
more exienaeu ana attractive. Some
special premiums are offered for county
exhibits of grains and grasses which we
think a good feature if the proper inter
est is manifested by tho several comities.
The society has determined not to
grent licenses for the running of any
gambling devices or for the sale of any
spirituous liquors on tho grounds, and
has resolved" to prosecute any persons
found so engaged. Having been able
topavoff itsmdebtedncssattho rate of
$3,0Ci) per annum for tho past three years
tho society is determined to go forward
to make the fair of 1834 the best ever
held in tho state, as it is promised to
sparo no effort to that end. The trans
portation companies have assured the
usual reduced rates.
In this connection it will be proper to
suggest that tho stats fair is an institu
tion that all our farmers and dairymen
and their families should take an,active
interest in, and it is not too soon for
such as purpose attending to lay out
their plans for exhibiting something on
that occasion. Tho mere desire to tako
a premium, however, should not be the
solo motive for preparing an exhibit.
Tho next fair will occur in the new year
for Oregon, when thero will be large
numbers of strangers within our borders,
many of whom will be seeking homes or
investments, and few of those will fail
to attend our state fair. This has always
been tho case to a limited extent, but
this year the number of sojourners who
will attend will bo multiplied by thous
ands. The reports these people take or
send back to their homes is a very im
portant matter to Oregon, and if a fair
interest is manifested by her own people
and only half exhibited that may be, the
impression on these strangers cannot
help but be pleasing, and will redound
greatly to Oregon's future prosperity.
