THE J I'll Y SYSTEM.
The jury system is simply with us
a lingeringvideuco of the marvelous
conservatism -of the Teutonic people,
and especially of the Anglo-Saxon
branch. In England, when the judi
ciary depended upon the crown it was
a bulwark between the citizen and a
power which was really absolute,
when it was applied through th
courts upon a oitizen.
It was a jury of the vicinage and
it was a jury of peers. It was the sole
barrier between the citizen and crown
or the judges of the crown. The in
quest by a jury of the vicinage, at
once jurors and witnesses, sitting
upon an accused neighbor, was a fea
ture which early disappeared, and, in
the rules of the exolusion of intelli
gence, the system has gone to the op
posite extreme. In America, with an
elective j udiciary, directly dependent
upon the people, there is no need for
a jury as a cushion between power
and the.citizen. In cities, where it
is sometimes asserted that lings
get possession of public affairs, it
is conceivablo that honest men
might occasionally need some
such barrier against injustice,
but it is precisely in cities that such
barrier would bo ineffectual, and
there that rings would probably ap
peal to the jury system as a way to
lay the responsibility for injustice off
upon an irresponsible part of the
judicial machinery.
Under any other judiciary system
than the elective, it is impossible to
conceive how the jury could I5e need
ed as a safeguard for the citizen.
Where governors change every four
years and legislatures change every
two years, no system of appointment
could be devised which would not
leave judges so closely dependent
upon popular power as to render it
unnecessary for that purpose. About
the most that can bo said for it is
that the judgment of twelve good men
and true is better than the judgment
as to facts of any learned lawyer fit
to be a judge. That a juror shall be
a freeholder or a householder has
proved no safeguard against ignor
ance and loafers in the jury box.
While good juries can still be had in
country districts and small towns,
they cannot often be had in large
cities. The question is new: How
long will" conservatism wrestle with
the patent evils of this system? The
administration of law is everywhere a
mockery, a sham, and an injustice.
Where justice is a failure the respon
sibility is laid off to be borne by the
irresponsible part of the judioial ma
chinery. "It was the jury," and that
is the end of it. The vilest criminal
is acquitted in the clearest case. "It
was the outrageous verdict of the
jury," and it must bo assumed that
the verdict was honestly rendered, or
if it is openly charged that it was
otherwise, there is no responsibility
and no means of reaching the case.
The jury can be made to bear all the
sins of the entire machinery of
justice and bear them comfortably;
for, when the jury disperses, there is
an end of it It is a convenient scape
to bear all sins off into the wilder
ness. As ic is, the jury system is a
failure, it is an utterly irresponsible
scape for the failures and shortcom
ings and misdeeds of the entire ma
chinery of justice.
VENTILATING BED3.
The London Lancethos heard with
satisfaction .that a ventilating bed
quilt has been invented, which it un
derstands to be a perforated coverlet,
with the holes filled with some sub
stance that will let vapor go through,
and that has been tested and works
to a charm. This fills a long-felt
want. Our unventilated beds are too
much like the woodchuck's hole,
leaving our noses the only ventilator,
while the body exudations are con
fined in the bedclothes. This may do
for the woodchuck in his weather sig
nal Eervice, but human beings are not
woodchucks.
A benevolent journal has inter
viewed leading New York phyeician
on the need and utility of this inven
tion, and he pronounces it a big thing
in saving life. He says that beds are
the chief cause of death, and proves
it by the fact that most people die in
bed. .This is the proof of statistics,
and they can .not lie. Said this med
ioal scientist:
When we consider how many folks
die in bed, there can be no doubt that
our beds are terribly unhealthy.
He demonstrated further that beds
are the cause of death by the unde
niable faot that in civilized countries
people spent as much as a third of
their time in bed, aud they die. Put
the two together, and we have the
cause and effect Said he:
Do we not all spend jicarly or
quite one-third of our time in bed,
and during nearly all of that time are
we not helpless in sleep death's
counterfeit? Helpless are we, then,
to detect the bad effect of sleeping in

that most people die in their beds,
and, therefore, that the bods are the
cause. Obviously we must quit beds
if we would live forever. But ther
is another fact bearing on this ques
tion. Behold the horse; how well he
sleeps, and how fresh and regularly
he rises. He never complains of
catching cold in bed. It is because
he sleeps with his shoes on; whereat
we wear our shoes through the day
and pull them off when we go to bed,
exposing our feet, thus made sensitive
to the chill. How can we expeot to
live if we do this violence to nature?
With shoes on and o porous bedquiltj
people migHt avoid dying till their
time comes. But if they will go on
sleeping in beds, when they see that
most people die in them, they must
expect to share the common fato.
The census report for 1880 contains
the most elaborate and valuable sta
tistics of railroads ever gathered by
any cotmtry in the world. The cost
of all the railroads in the country
and their equipment is put at some
thing over $4,530,000,000; their aggre
gated funded debt reaches $2,390,000,
000, or as muoh as the total interest
bearing national debt and the munici
pal debt of the country combined,
and their income is $661,000,000 per
year, of whioh $527,000,000 goes for
expenses and $134,000,000 to the profit
account. These roads are owned by
300,000 persons, a muoh larger num
ber than is generally supposed. The
number of employes is 419,000.
The Seattle papers have opened out
against the Northern Pacific land
grant and demand its forfeiture. It
took our Seattle contemporaries a
long time to realize the ones idedn ess
of unearned railroad grants, but now
they are atoning for their late con
version by the most zealous denunci
ation of the proposed plan.
Advices from Vienna state that
there is a strong movement on foot
in the Province of Galicia in favor of
emigration to Amerioa. The magis
tracy of East Galicia have unani
mously petitioned the governor of the
province to prohibit the sale of pas
senger tickets for American ports.
