The supremo court of the United States rendered a decision on the 4th inst, in the legal-tender case of Juilliard vs. Greenmad, -which has been pending for borne time and which involved the question whether notes of the United States issued in time of war under acts of congress de claring them m to be legal-teudor in payment of private debts, and after ward in time of peace redeemed and paid in gold coin at the treasury, and then reissued under the act of 1878 can, under the constitution of the United States, be a legal tender in payment of such debts. The court held that the present case cannot be distinguished in principle from the case3 classed as legal-tender eases heretofore decided'by the court, and decides that the act of 1878 is consti tutional In the concluding para graph of its opinion, which contains the gist of the decision, the court says: "Congress, as the legislature of a sovereign nation, being expressly empowered by .the constitution 'to levy and collect taxes to pay the debts and provide for the common defense and general welfare of the United States,' and to 'borrow money on the credit of the United States, and 'to coin money and regulate the value thereof and of foreign coins,' and be ing clearly authorized, as incidental to the exercise of those gret powers, to emit bills of credit, to charter national banks, and provide a na tional currency for the whole people, in theform of coin, treasury notes and national bank bills, and the power to make the notes of the government a legal tender in the payment of private debts, being one of the powers belonging to sovereignty in other civilized nations, and not expressly withheld from con gress by the constitutions, we are ir resistibly impelled to the conclusion that the impressing upon the treas ury notes of the United States the quality of being a legal tender in payment of private debts, is an ap propriate means, conducive and plain ly adapted to the execution of the undoubted powers of congress, con sistent with the "letter and spirit of the constitution, and, therefore, with in the meaning of that instrument necessary and proper for carrying into execution the powers vested by the constitution in the government of the United States. Such being our conclusion in the matter of law, the question whether at any particular time, in war or in peace, the exigency is such by reason of unusual and pressing demands on the resources of the government, or of the inadequacy of the supply of gold and silver coin to furnish the currency needed for the uses, of the government and of the people that it is, as a matter of fact, wise and expedient to resort to this means, is a political question to be determined by congress when the question of exigency arises, and not a judicial question to be afterward passed upon by the courts. It fol lows that the act of May 31, 1878, is constitutional and valid." A strong dissenting opinion is filed by Judge Field, who, in concluding, very point edly says: "If congress has the power to make the notes of the United States a legal tender and to innko thorn paaa ns money, it may be asked what neces sity was there lo invest it by the con stitution witn power, to borrow money? If it can make money, why borrow it? And if the notes of the united States, with a legal-tender quality, ae money or the equivalent oi money, wny snould congress not at once issue a sufficient amount to pay all the bonds of the United States? Why pay interest on a thou sand million of dollars of bonds when it can in one day make the money, to pay them? It would not, indeed; sur prise me if there be a call from many quarters upon . the goverment- to ia' sue such notes for the bonds. "Who can object to it if the doctrine de clared by the court is sound? And why should there be. any restraint upon the unlimited appropriations by the government for all imaginary schemes of public improvement if the printing press can furnish all the money that is needed for them?" "We are, therefore, as rauoh in the dark as ever with respect to the health of the great candidate. "Why not send a commissioner to Greystone and lot us know exactly how he is? This un certainty is painful. Let all the presidential candidates of both part ies be authorized to diagnose the case and give the country an acourate report. For our part we believe that Mr. Tilden died years ago and that some impostor is deceiving the west ern tategmen who visit his old home. Talking of the effort to tax money in general, and of the mortgage tax law in particular, the Oregonian com presses a good deal of financial truth into the following paragraph: "All experience shows that the way to make money abundant and cheap is to let it entirely alone. Mou in Port land who refuse to lend on mortgage when ten per cent, is offered invest large sums in government bonds at less than half that rate of interest. Why? Because government bonds escape publicity, and because the government bond is subject to no charges and gives the investor no trouble. A like policy on the part of the state would make money abun. dant and cheap for all purposes. But men will not lend money, except at high interest, under conditions which spread the transaction before the world and subject the evidence of the debt to tax charges whioh never can be foreknown, but which will cer tainly be three, four or five times higher than the tax charges on prop erty in other forms." Henry Villabd's proposed trip to Europe for the benefit ot his broken health has apparently been postponed and he appears down, town again in New York. His -wife retains the $250,000 place on the Hudson from the wreck of hec- husband's fortune, and the family are still occupying their great kouse in New York, the interior of which is said to resemble an Italian palace. . It would seem that the wreck was not so complete after alL The unfortunate stock holders of the Transcontinental com pany threaten suits against the direc tors for deception. Pending presidential nominations the eastern press is hard up for sen sational editorializing.. The World "smells the blood of an Englishman" and says our beloved country and its republican institutions are in danger, for the Saxoa from over the sea has in the last few years bought 20,000, 000 acres of American soil The argument is made that England is trying to do in the nineteenth, what she failed to do in the eighteenth century conquer the "United StateB, and the British monarchy and ariutoc raoy are to be transferred to this side of the Atlantic. The Temple of Jerusalem, writes a special Paris correspondent of the Pilot, is to be rebuilt by the com bined efforts and contributions of twelve American millionaires, two of whom have already gone to Palestine to Btudy on the spot the most efficient means of putting into execution their gigantic and oo3tly project. A "GENTiiEirAN of education and ex perience1 advertises in a Des Moines paper for employment in writing speeches for members of the legisla ture.
